AN EMERGENCY ORDINANCE OF THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING
SECTION 20-11 OF THE OCCUPATIONAL LICENSE SEC-
TION OF THE MIAMI BEACH CITY CODE BY ADDING A
NEW SECTION 20-11(2).1 PROVIDING FOR AN ANNUAL
FEE FOR OCCUPATIONAL LICENSES FOR ADULT CON-
GREGATE LIVING FACILITIES; PROVIDING FOR
SEVERABILITY; REPEALING ALL ORDINANCES IN CON-
FLICT HEREWITH; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA:
SECTION 1 DECLARATION OF PURPOSE
This measure is adopted by the City Commission as an emergency
measure due to the requirement imposed by the Florida Department of
Health and Rehabilitative Services that adult congregate living
facilities be licensed by the end of this month, September, 1982.
In view of the need for such licensing, an amendment to the
schedule of fees contained in the occupational license section of
the City Code is hereby made for adult congregate living facil-
ities.
SECTION 2
Section 20-11 of the Miami Beach City Code is hereby amended by the
addition of Section 20-11(2).1 which shall read as follows:
Sec. 20-11. Schedule fees.
(2).1 Adult Congregate Living Facility...
(a) First ten rooms $150.00
(b) Each additional room $ 5.00
SECTION 3 SEVERABILITY
If any section, sub -section, sentence, clause, phrase or portion of
this Ordinance is, for any reason, held invalid or unconstitutional
by any court of competent jurisdiction, such portion shall be
deemed a separate, distinct and independent provisions and such
holding shall not affect the validity of the remaining portions of
this Ordinance.
SECTION 4 REPEALER
That all Ordinances or parts of Ordinances in conflict herewith be
and the same are hereby repealed.
SECTION 5 EFFECTIVE DATE
This is an emergency ordinance and shall take effect immediately.
