AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, REPEALING IN ITS EN-
TIRETY CHAPTER 33 OF THE MIAMI BEACH CITY CODE
DEALING WITH REAL ESTATE BROKERS AND SALESMEN;
REPEALING ALL CONTRARY ORDINANCES; PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA:
SECTION 1 LEGISLATIVE PURPOSE
Since the licensing and regulation of real estate salesmen and bro-
kers has been preempted to the State through Chapter 475 of the
Florida Statutes pertaining to real estate brokers, salesmen and
schools, municipalities are precluded from licensing and regulating
this subject. Therefore, §§33-1 through 33-14, inclusive, of the
Miami Beach City Code regulating real estate brokers and salesmen
are hereby repealed.
SECTION 2 OTHER ORDINANCES
All ordinances or parts of ordinances in conflict herewith be and
the same are hereby repealed.
SECTION 3 SEVERABILITY
If any article, section, subsection, sentence, clause, phrase, or
portion of this ordinance is, for any reason, held invalid or un-
constitutional by any court of competent jurisdiction, such portion
shall be deemed a separate, distinct and independent provision and
such holding shall not effect the validity of the remaining portions
of this ordinance.
SECTION 4 EFFECTIVE DATE
This ordinance shall take effect ten (10) days after adoption in
accordance with law, on September 25 1982.
