AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AMENDING CITY OF
MIAMI BEACH ORDINANCE NO. 90-2701 WHICH
CREATED CHAPTER 15-A OF THE CODE OF THE CITY
OF MIAMI BEACH ENTITLED "CITY OF MIAMI BEACH
HEALTH FACILITIES AUTHORITY" BY CHANGING THE
REPORTING PERIOD SET FORTH IN SECTION 4 (s)
THEREOF FROM A CALENDAR YEAR TO A FISCAL YEAR,
AND DELETING THE REQUIREMENT IN SECTION 20
THEREOF THAT THE CITY COMMISSION APPROVE THE
ADMINISTRATIVE GUIDELINES; REPEALING ALL
ORDINANCES IN CONFLICT THEREWITH; PROVIDING
FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA.
SECTION 1. Section 4 (s) of City of Miami Beach Ordinance No.
90-2701 entitled "Powers and Duties of the Authority" is hereby
amended to read as follows:
Section 4 . Powers and Duties of the Authority.

(s) To make a report to the Commission within the
first 90 days of each alcndar fiscal year for the
City, or the Authority' s activities for the
preceding calendar fiscal year. Each such report
shall set forth a complete operating and financial
statement covering its operation during the
preceding fiscal year.
SECTION 2 . Section 20 of City of Miami Beach Ordinance No. 90-
2701 entitled "Administrative Procedures" is hereby amended to read
as follows:
Section 20. Administrative Procedures.
The Authority shall adopt administrative guidelines
and procedures in connection with the exercise of
its powers hereunder which shall become effective
upon approval by the Commission which may be
amended by the Authority from time to time. Such
guidelines and procedures shall only be amended by
SECTION 3 . REPEALER
All ordinances or parts of ordinances in conflict herewith be
and the same are hereby repealed.
SECTION 4. SEVERABILITY
If any section, sentence, clause or phrase of this ordinance
is held to be invalid or unconstitutional by any court of competent
jurisdiction, then said holding shall in no way affect the validity
of the remaining portions of this ordinance.
SECTION 5. EFFECTIVE DATE
This ordinance shall take effect ten (10) days after its
adoption on March 14 , 1992 .

AND TO DELETE THE REQUIREMENT THAT THE ADMINISTRATIVE
PROCEDURES OF THE AUTHORITY BE APPROVED BY THE CITY
COMMISSION.
The attached Ordinance was requested by the Miami Beach Health
Facilities Authority at its meeting of February 11, 1992 .
The Ordinance provides for the change in the Authority's reporting
period to the City Commission from a Calendar year to the City's
Fiscal year and deletes the requirement that the administrative
procedures of the Authority be approved by the City Commission.
