AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO.
1335, REGULATING THE GRANTING OF ANNUAL LEAVE,
SICK LEAVE, AND OTHER LEAVE FOR EMPLOYEES;
AMENDING THE CONDITIONS GOVERNING THE DONATION
OF ANNUAL LEAVE AND SICK LEAVE; REPEALING ALL
ORDINANCES IN CONFLICT; AND PROVIDING FOR AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA:
SECTION 1.
That Sent i nn 2 - paragraph : 6 of Ordinance No, 1115 i s 1_ rphy
amended to read as follows:
16. Donation of Annual Leave and Sick Leave
In those instances where a permanent full-time
employee is affected by a non-job related
illness which causes the total depletion of
their annual leave and sick leave, other City
employees may donate annual and/or sick time
on a pro-rata basis to that particular
employee' s leave balance. In the event the
Governor declares a state of emergency in an
area which includes the City of Miami Beach,
and the donated time will be used for a City
employee to assist another City employee whose
property has been damaged by the emergency,
City employees may donate annual and/or sick
time on a pro-rata basis, subject to the prior
approval of the City Manager.
SECTION 2 . SEVERABILITY.
If any section, sentence, clause or phrase of this Ordinance is
held to be invalid or unconstitutional by any court of competent
jurisdiction, then said holding shall in no way affect the validity
of the remaining portion of this Ordinance.
SECTION 3 . REPEALER.
All ordinances or parts in conflict herewith be and the same are
hereby repealed.
SECTION 4. EFFECTIVE DATE.
This is an Emergency Ordinance which shall take effe - immediately.
