Ordinance 93-2874 ORDINANCE NO. 93-2874 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING CHAPTER 14B OF THE CITY CODE ENTITLED "INTERIM GENERAL AND PROPRIETARY SERVICES FEE", BY AMENDING SECTION 14B-5 ENTITLED "CHARGES"; TO PROVIDE FOR AN INCREASE IN THE FEE FROM THREE CENTS ($0. 03) TO FOUR CENTS ($0 . 04) PER SQUARE FOOT OF FLOOR AREA PER MONTH; PROVIDING FOR A REPEALER; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 14B of the Code of the City of Miami Beach entitled "Interim General and Proprietary Services Fee" was created on December 6, 1989 , by Ordinance 89-2669 ; and, WHEREAS, it is the intention of the Mayor and City Commission to maintain a fair and equitable means to ensure that the City is compensated for municipal services provided; and, WHEREAS, due to the additional cost for providing increased levels of municipal services, it is requested that the "Interim General and Proprietary Services Fee" be increased from three cents ($0. 03) to four cents ($0 . 04) per square foot of floor area per month. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. That Chapter 14B-5 of the Code of the City of Miami Beach, Florida entitled "Charges" be amended to read as follows: Section 14B-5 Charges. For the purpose of this section, a "unit" shall be defined as a single-family residence; each dwelling unit of a townhouse, duplex or multi-family dwelling; hotel room or suite; Adult Congregate Living Facility unit; a single-tenant industrial space; in an office or commercial building; or a warehouse bay, except those warehouse facilities subdivided and used primarily as leased storage units, which shall be considered one unit per structure. The term shall include additions to units, such as additional rooms, but shall not include maintenance, pools, fences, or remodeling which does not result in a net increase in square footage, for which no fee shall be required. The fee shall be thrcc four cents ($0. 03) ($0 . 04) per square foot of floor area per month. SECTION 2 - REPEALER. All ordinances or parts of ordinances in conflict with the provi3ions of this ordinance are hereby repealed. SECTION 3 - SEVERABILITY. If any section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. SECTION 4 - EFFECTIVE DATE. RECOMMENDATION The Administration recommends that the City Commission adopt on second and final reading, the attached Ordinance amending Miami Beach City Code Chapter 14B Section 14B-5, entitled "Charges" providing for an increase in the fee from three cents ($0. 03) to fn,,"" cents ($0. 04) per square foot of floor area per month. First reading of the ordinance was held on September 8, 1993. It should be noted that adoption of this ordinance is crucial to the implementation of the Fiscal Year (FY) 1993-94 Budget. BACKGROUND In the FY 1993-94 Budget an increase in the "Interim General and Proprietary Services Fee" was proposed from three cents to four cents per square foot of floor area per month. The purpose of this fee is to compensate the City for providing municipal services during the period of time which elapses between issuance of a certificate of occupancy (CO) on a dwelling, and its subsequent assessment by the Property Appraiser and inclusion on the tax roll. This rate is consistent with fees set by Dade County. Preliminary projections indicate that this increase will provide an additional $100, 000 of revenue to the City' s General Fund. PROCEDURE Miami Beach City Code, Chapter 14B Section 14B-5 establishes the "Interim General and Proprietary Services Fee" and charges therefor. In order to effectuate this proposed fee increase in a • timely manner, it is necessary to amend Chapter 14B Section 14B-5 such that this fee increase will coincide with the beginning of the new fiscal year on October 1, 1993 .
