Ordinance 94-2920 ORDINANCE NO. 94-2920 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING ORDINANCE NO. 789, THE CLASSIFIED EMPLOYEES SALARY ORDINANCE, ABOLISHING THE CLASSIFICATIONS OF CONVENTION CENTER EVENTS COORDINATOR, CONVENTION CENTER MAINTENANCE MECHANIC, CONVENTION CENTER SUPERVISOR II, AND STAGE MANAGER; PROVIDING FOR A TWO PERCENT (2%) SALARY INCREASE TO THOSE CLASSIFICATIONS IN THE CLASSIFIED SERVICE NOT COVERED BY A BARGAINING UNIT IN GROUP V.A AND GROUP V.B; REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City is no longer utilizing the classifications of Convention Center Events Coordinator, Convention Center Maintenance Mechanic, Convention Center Supervisor II, and Stage Manager; and WHEREAS, the City Commission, on April 8, 1993, approved the Labor Agreement with the American Federation of State, County, and Municipal Employees (AFSCME) ; and WHEREAS, that AFSCME Labor Agreement contained a Wage Agreement including an initial two percent (2%) salary range increase effective April 1, 1993, and a second two percent (2%) salary range increase to be effective May 1, 1994, for all classifications covered by the AFSCME Labor Agreement; and WHEREAS, effective April 5, 1993, the Mayor and Commission granted the Group V - "Other Classifications in the Classified Service" not covered by a bargaining unit (Others) the same initial two percent (2%) salary increase granted to the AFSCME classifications; and WHEREAS, the Mayor and Commission desire to again grant the "Others" classifications the same second two percent (2%) salary increase as is being granted to the AFSCME classifications. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That the following lines in Section 1 of Ordinance No. 789 as heretofore amended, which read as follows: GROUP V.A OTHER CLASSIFICATIONS IN THE CLASSIFIED SERVICE - COMMENCING EMPLOYMENT PRIOR TO AUGUST 1, 1993. Canto City Manager SUBJECT: AN ORDINANCE AMENDING ORDINANCE NO.789, BEING THE CLASSIFIED EMPLOYEE SALARY ORDINANCE, PROVIDING FOR A 2%SALARY INCREASE OF"GROUP V-OTHER CLASSIFICATIONS IN THE CLASSIFIED SERVICE"NOT COVERED BY A BARGAINING UNIT AND ABOLISHING SPECIFIED CLASSIFICATIONS ADMINISTRATION RECOMMENDATION: The Administration recommends that the City Commission adopt on second reading the attached Ordinance which amends the Classified Employee Salary Ordinance, No. 789, to provide for a two percent (2%) salary range increase for classifications in"GROUP V-Other Classifications in the Classified Service" not covered by a bargaining unit ("Others") effective May 1, 1994. BACKGROUND: The first reading of this Ordinance took place on April 20, 1994. "Other Classifications In The Classified Service" includes approximately 174 employees in various job classifications that are determined to be confidential/supervisory. Although these classifications are in the Classified Service and are covered by the Civil Service Rules, they are not represented by any of the City's bargaining units. Historically the wage increases for "Others", classified classifications not covered by a bargaining unit, have been based upon the negotiated increases provided to the MBEBA bargaining unit. However, in 1993, the MBEBA was the only one of the City's four bargaining units which had not successfully negotiated a new Labor Agreement. Therefore, it was proposed that the"Others"employees should not continue to be penalized for the MBEBA's failure to negotiate and that the"Others" employees should be granted a 2% increase which had already been provided to the other three bargaining units (AFSCME, FOP, and IAFF). On July 28, 1993, the City Commission approved the Administration's proposal to grant "Others" the same 2% increase as had been granted to AFSCME, retroactive to April 5, 1993. This was consistent with the 2% increase, effective April 15, 1993,which had already been granted to AFSCME, FOP, and IAFF bargaining units. Two additional 2% increases have been granted to the FOP and IAFF; one being effective October 1, 1993, and the other being effective January 1, 1994. There is a second 2% increase for AFSCME before the Commission today, in accordance with the negotiated Labor Agreement. The City's Convention Center is now managed and staffed by Spectacor Management Group,therefore the City no longer utilizes the classifications of Convention Center Events Coordinator, Convention Center Maintenance Mechanic, Convention Center Supervisor II and Stage Manager. ANALYSIS: In order to remain consistent with the July 28, 1993, action, when "Others" were granted the same 2% increase as AFSCME, FOP, and IAFF, it is proposed that "Others" be granted a second 2% increase effective May 1, 1994, paralleling the increase for AFSCME. ,Z2 This will result in a total of 4% increase for "Others" as compared to a total of 4% increase for AFSCME during the three (3) year contract through April, 1995, (if the second 2% increase is granted by the Commission today) and 6.5% for both FOP and IAFF during the two and one half (2 1/2) year contract through September, 1994. ITEM V COMMISSION MEMO ORDINANCE 789 "OTHERS" Page 2 The significant component of a 15% bifurcation step-down for new employees has been implemented for "Others" as it • was done for all four bargaining units,AFSCME, FOP, IAFF, and the previous MBEBA. Implementation of the 2% salary increase for approximately 174 covered employees for the remaining five (5) months of the current fiscal year is projected to cost $25,000. Funding of this amount is provided for in the current budget. CONCLUSION: Adoption of this Ordinance provides a wage increase to the "Other Classifications in the Classified Service" not covered by a bargaining unit similar to that of the AFSCME, FOP, and IAFF bargaining units and provides for the abolishment of classifications which are no longer used.
