AN ORDINANCE OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA AMENDING ORDINANCE
1901, THE GENERAL EMPLOYEE'S PENSION
SYSTEM BY ESTABLISHING AN EFFECTIVE
DATE FOR THE SYSTEM'S ASSUMPTION OF
THE ADMINISTRATIVE COSTS OF THE
SYSTEM, PROVIDING FOR A REPEALER,
SEVERABILITY AND AN EFFECTIVE DATE.
Whereas, the negotiations with the various employee bargaining
units have now been concluded; and,
Whereas, all of the contracts that have been approved include
the provision for the administrative cost of the retirement system
to be paid for by the system; and,
Whereas, the City needs to amend the Ordinance to reflect this
provision as of the dates it was implemented for the various units
within the General Employee's Retirement System.
Now, Therefore, be it Ordained by the Mayor and City Commission of
the City of Miami Beach, Florida:
Section 1 - That Section 6. 03 (a) of Ordinance 1901 be amended as
follows:
6. 03 Contributions by City
(a) It is the intent of this Ordinance that the City
contribute to the System each year the amounts actuarially
determined to be required, in addition to contributions by Members,
to cover the cost of the benefits provided by the System. Provided,
however, for Members in the classifications within the AFSCME unit
after April 30, 1993 , and for Members within the classifications
within the Other unit after July 31, 1993 , and for Members in the
classifications within the MBEBA after February 21, 1994, all
administrative expenses shall be paid by the System.
Section 2 - Repealer
All Ordinances or parts of Ordinances in conflict herewith be
and the same are hereby repealed.
Section 3 - Severability
If any section, sentence, clause or phrase of this ordinance
is held to be invalid or unconstitutional by any court of competent
jurisdiction, then said holding shall in no way affect the validity
of the remaining portions of this ordinance.
Section 4 - Effective Date
This ordinance shall become effective ten days after its
adoption.

Subject: Amendment to the General Employee's Pension Ordinance
Administrative Recommendation
The Administration recommends that the City Commission adopt
this Ordinance on second reading after a public hearing.
Background
As part of the negotiations with the American Federation of
State, County and Municipal Employees (AFSCME) and the Miami Beach
Employees Benevolent Association (MBEBA) the administrative cost of
the General Employee's Retirement System was to be paid from the
assets of the System rather than by the City. This provision was
not practicable to implement prior to the point at which the tw-
unions and the unrepresented employees within the plan had adopted
this language in their contracts. Since negotiation with the
bargaining units is complete and the City Commission has accepted
the recommendations of the Special Master, the City wishes to amend
this provision in the General Employee's Retirement System to
reflect implementation as of the effective dates of the contract
with each group.
Analysis
The effect of this change will allow the City to recover
approximately $310, 000 in administrative costs paid to the System
from the implementation of the first contract (AFSCME) in April,
1993 through the date of the last contract (MBEBA) in February,
1994 . The Administration will prorate the costs associated with the
administration of the System based on the relationship of the
members of each unit to the total system. The Board of Trustees of
the System have recommended that the Administration adopt such an
amendment to the System so that they may correctly reimburse the
City.
Conclusion
•
This amendment to the General. Employee's Retirement System is
recommended by both the Board of Trustees and the Administration as
necessary to properly reflect the effect of the negotiation process
on the System. It will also allow the City to recover approximately
$310, 000 in costs previously paid on behalf of the System.
