AN EMERGENCY ORDINANCE OF THE MAYOR AND
CITY COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA, AMENDING MIAMI BEACH CITY CODE
CHAPTER 45, ENTITLED "WATER", AMENDING
SECTION 45-4, ENTITLED "SCHEDULE OF RATES AND
TAPPING CHARGES" BY RAISING THE RATES
CHARGED BY THE CITY FOR WATER SUPPLY
SERVICE TO NON-MUNICIPAL CONSUMERS OF
WATER, EFFECTIVE FOR METER READINGS TAKEN
ON OR AFTER OCTOBER 1, 1994;AND BY INCREASING
THE MINIMUM MONTHLY CHARGE FOR SUCH
SERVICE;REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Miami Dade Water and Sewer Authority will be increasing the
wholesale water and sewer rates for the fiscal year, beginning October 1, 1994; and
WHEREAS, it is necessary to pass these rate increases on to the consumers; and
WHEREAS, if the City's proposed rate increases do not go into effect by the date
when the County's increase becomes effective, the City will lose revenues necessary to
provide needed services to its citizens; and
WHEREAS, in order to have the City's increased water and sewer rates effective on
the date when the County's increases become effective, it is necessary to adopt these
increases as an emergency ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1: That Section 45-4 of Chapter 45, entitled "Water" of the Code of the City
of Miami Beach, Florida, be and the same is hereby amended as follows:
Sec. 45-4. Schedule of rates and tapping charges.
(a) The meter rate to non-municipal consumers for water supply service in
the territory shall decrease increase from fr-1732$1.22 per thousand gallons
to $4722$1.26 per thousand gallons from June 1 through November 30, and
increase from€4732 $1.37 per thousand gallons to$44-7 $1.48 per thousand
gallons from December 1 through May 31.

(c) The water rate shall decrease increase from $1.32 $1.22 per thousand
gallons to $-12 $1.26 per thousand gallons from June 1 through
November 30, and increase from$4732 $1.37 per thousand gallons to$4.37
$1.48 per thousand gallons from December 1 through May 31 for non-
municipal consumers of water as set forth in Section 1 of this Ordinance
is to be applied to all water billings based on meter readings taken on or
after October 3, 1993 1994.
(d) Every water supply service shall have a monthly minimum service
charge on each service installed, varying with and based upon the size of
the service pipe required and installed in accordance with the rules of the
Public Works Department. This minimum charge shall be in accordance
with the following schedule and shall entitle the consumer, without excess
charge, to have supplied through the meter the number of gallons of water
set forth in the table.

There shall not be a rental charge on meters.

SECTION 2: REPEALER. That all ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.
SECTION 3: SEVERABILITY. If any section, sub-section, sentence, clause, phrase or
portion of this Ordinance is,for any reason, held invalid or unconstitutional
by any court of competent jurisdiction, such portion shall be deemed a
separate, distinct and independent provision and such holding shall not
affect the validity of the remaining portions of this Ordinance.

SECTION 4: EFFECTIVE DATE. Pursuant to Section 2.05 of the City Charter this
emergency ordinance shall become effective on the 1st day of
October, 1994.

ADMINISTRATION RECOMMENDATION:
The Administration recommends that the Ciry Commission approve an emergency
ordinance amending Chapter 45, Section 45-4 of the Miami Beach City Code to change the
schedule of rates for water supply service to non-municipal consumers of water including
provisions for a wet season rate (June 1 through November 30) and a dry season rate
(December 1 through May 31) to promote conservation of water as follows: June 1 through
November 30 - from One Dollar and Twenty-Two Cents ($1.22) per thousand gallons to
One Dollar and Twenty-Six Cents ($1.26) per thousand gallons; December 1 through May
31 - from One Dollar and Thirty-Seven Cents ($1.37) per thousand gallons to One Dollar
and Forty-Eight Cents ($1.48) per thousand gallons; increase the minimum monthly service
charge; provide for severability; repeal all ordinances in conflict herewith; and provide for
an effective date of October 1, 1994.

BACKGROUND
The Miami-Dade Water and Sewer Authority Department is increasing the average
wholesale water rate for the fiscal year beginning October 1, 1994, and it is necessary to
pass these rate increases on to the consumers.
In keeping with the Miami - Dade Water and Sewer Authority rate increases, on
September 8, 1994 the City Commission approved an ordinance which parallels the Miami-
Dade Water and Sewer Department wholesale rate increase to municipal customers by
amending Chapter 45, Section 45-4 of the Miami Beach City Code to pass these increased
rates to consumers. If the City's proposed rate increases do not go into effect by the date
when the County's increase becomes effective, the City will lose revenues necessary to
provide needed services to its citizens.
However, an ordinance does not become effective until at least 10 days after adoption
unless they are passed as emergency ordinances. In order to have the City's increased
water and sewer rates effective on the date when the County's increases become effective,
it is therefore necessary to adopt these increases as an emergency ordinance. Due to notice
requirements, the second reading of the emergency ordinance must be changed from
September 22, 1994 to September 26, 1994.
CONCLUSION
It is recommended that the City Commission of the City of Miami Beach approve this
emergency ordinance and reschedule the second reading of the proposed ordinance from
September 22, 1994 to September 26, 1994.
