Ordinance 94-2941 ORDINANCE No. 94-2941 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING MIAMI BEACH CITY CODE CHAPTER 20, ENTITLED "BUSINESS LICENSES," SECTION 20-11, ENTITLED "SCHEDULE OF FEES" TO CREATE A SEPARATE CLASSIFICATION AND FEE FOR "ART GALLERY"; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the business community has expressed certain concerns related to the existing occupational license fees for art galleries, and WHEREAS, in response to these concerns the City Administration initiated a review of the current occupational license ordinance as it relates to said galleries, and determined that art galleries should no longer be classified with antique dealers and should be a separate classification with a different license fee as set forth herein. NOW, THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. AMENDMENT OF SECTION 20-11. That Section 20-11, entitled "Schedule of Fees" of Miami Beach City Code Chapter 20, entitled "Business Licenses" is hereby amended as follows: (10) Antique Dealer/Art Gallery $750. 00 * * * (86) Gallery : - - :-. - $750. 00 300. 00 * * * SECTION 2 : REPEALER: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 3: SEVERABILITY: If any section, sub-section, sentence, clause, phrase, or portion of this ordinance is for any reason, held invalid or unconstitutional by a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions of this ordinance. SECTION 4 : EFFECTIVE DATE: That this ordinance shall take effect ten days after its adoption on October 15 , 1994 . Passed and adopted this 5th day of October , 1994 . Carlto City Manager SUBJECT: AMENDMENT OF CHAPTER 20 OF THE CODE OF THE CITY OF MIAMI BEACH ENTITLED "BUSINESS LICENSES". ADMINISTRATIVE RECOMMENDATION The Administration recommends that the City Commission adopt on second reading the attached ordinance amending Chapter 20 of the Miami Beach City Code as outlined herein. BACKGROUND A review of the sections of our existing license ordinance that deal with art galleries was instituted in response to numerous comments from gallery owners. At the conclusion of our study, it was determined that most galleries offer a limited number of showings per year as opposed to businesses which maintain a daily inventory of art. Based on our findings, it is thereby recommended that a flat fee of $300 per year for art galleries would be more equitable. Heard and approved at first reading on September 13 , 1994 . ANALYSIS The proposed amendment establishes a separate category for art galleries with an annual license fee of $300.
