RESOLUTION NO. 2223
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA,
VACATING A PORTION OF 47th COURT AN
GRANTING SUCH VACATED PORTIONS THERE-
OF TO THE 47TH STREET COMMUNITY CEN-
TER, INCORPORATED, THEIR SUCCESSORS
AND ASSIGNS .
WHEREAS, it appears from a survey made of
Lots 7, 8, 9, 10 and 11 of the Resubdivision of
Lot 13 in Block 32, Lake View Subdivision, as
said Resubdivision is shown on a plat recorded
in Plat Book No. 27 at Page 17, of the Public
Records of Dade County, Florida , that the build-
ing thereon erected projects beyond the north
line of said Lots 7, 8, 9, 10 and 11, a distance
of not to exceed Two-tenths (0.2) feet, and
WHEREAS, it appears that said building also
i projects over the west line of the said Lot 11, a
distance of not to exceed Four-tenths (0.4) feet,
and,
WHEREAS, it also appears that the northwest
and the southwest corners of said building also
project over the northwest and southwest circular
corners of said Lot 11, all as shown on a Plat of
1 Survey prepared by The Giersch Engineering Com-
pany of Miami, Florida, for The Federal Bond &
Mortgage Company of Miami, Florida, a copy of said
plat being attached hereto and made a part of this
resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, That
that portion of 47th Court occupied by a portion
of the present building erected over said Lots 7,
8, 9, 10 and 11, and as shown by the attached sur-
vey plat above referred to, be , slad it is hereby va-
cated, and the use of such vacated portion of said
47th Court be and the same is hereby granted to The
47th Street Community Center, Incorporated, of
Miami Beach, Florida, their successors and assigns,
subject to the proviso hereinafter contained .
PROVIDED, HOWEVER, that if the buildin now on
said premises and covering the above described land
is ever moved, demolished, destroyed by fire or re-
built, then the above vacation of said portion of
said 47th Court and the grant of the use of the same
shall be immediately revoked, terminated and abso-
lutely voided without any action on the part of the
City Council of the City of Miami Beach, Florida,
and said lands above described shall again become a
portion of said 47th Court for the public use .
PASSED AND ADOPTED this 5th day of March, A. D.
1930.
