Resolution 2256 RESOLUTION NO. 2256 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, VACATING A PORTION OF COLLINS AVENUE AND GRANTING SUCH VACATED PORTIONS THEREOF TO THE TWENTY-THIRD STREET REALTY CORPORATION, THEIR SUCCESSORS AND ASSIGNS. WHEREAS, it appears from a survey made by the Biscayne Engineering Company, Miami , Florida, of a tract located east of Collins Avenue between 22nd Street and 23rd Street, designated, "Pavilion Block" on a plat recorded in Plat Book No. 5 at Pages 7 and 8, of the Public Records of Dade County, Florida,, that portions of the building thereon, which fronts on Collins Avenue, project beyond the property line into Collins Avenue not exceeding Fifteen-Hundredths (0.15) feet, as shown on a plat of said property pre- pared by the said Biscayne Engineering Company, copy of which is attached hereto and made a part of this resolution, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, That that portion of Collins Avenue encroached upon or oc- cupied by portions of the present building erected on the above described parcel of land, and as shown by the attached survey plat above referred to, be and it is hereby vacated, and the use of such vacated portion of said Collins Avenue be and the same is hereby granted to the Twenty-Third Street Realty Corporation 1 of Miami Beach, Florida., their successors and assigns, subject to the proviso hereinafter contained. PROVIDED, HOWEVER, That if the building now on said premises and covering the above described land is ever moved, demolished, destroyed by fire or rebuilt, then the above vacation of said portion of said Collins Avenue and the grant of the use of the same shall be immediately revoked, terminated and absolutely voided without any action on the part of the City Council of the City of Miami Beach, Florida, and said lands above described shall again become a portion of said Collins Avenue for the public use.
