Ordinance 95-5994 ORDINANCE NO. 95-2994 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING MIAMI BEACH CITY CODE CHAPTER 14, ENTITLED "FIRE PREVENTION", AMENDING SECTION 14-2, ENTITLED "ADOPTION BY REFERENCE", ADOPTING THE 1985 EDITION OF THE NATIONAL FIRE PROTECTION ASSOCIATION LIFE SAFETY CODE AS TO EXISTING BUILDINGS OR STRUCTURES; PROVIDING FOR A REPEALER, SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, Miami Beach City Code Section 14-2 presently adopts the 1991 edition of the National Fire Protection Association Life Safety Code (1991 Life Safety Code); and WHEREAS, the 1991 Life Safety Code requires that all existing high rise buildings install an approved supervised automatic sprinkler system; and WHEREAS, it is onerous for existing buildings to comply with this requirement; and WHEREAS, the 1985 edition of the Life Safety Code does not require existing buildings to install fire sprinkler systems; and WHEREAS, it is necessary to amend Miami Beach City Code Section 14-2 in order to adopt the 1985 Life Safety Code only as it pertains to existing buildings or structures. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. AMENDMENT OF CITY CODE SECTION 14-2. That Section 14-2 of Miami Beach City Code Chapter 14, entitled "Fire Prevention" is hereby amended as follows: Sec. 14.2. Adoption by reference. The National Fire Protection Association (NFPA) 101, Life Safety Code, 1085 1991 edition is hereby adopted by reference as to new buildings or structures as if fully set forth herein, as said Code may be amended from time to time. The National Fire Protection Association (NFPA)101, Life Safety Code, 1985 edition is hereby adopted by reference as to existing buildings or structures as if more fully set forth herein. New and existing buildings or structures shall be defined as in Section 633.025(7), Florida Statutes (1993). SECTION 2. REPEALER. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 3. SEVERABILITY. If any section, subsection, clause or provision of this Ordinance is held invalid, the remainder shall not be affected by such invalidity. SECTION 4. EFFECTIVE DATE. This Ordinance shall take effect on the 27th day of May, 1995. PASSED and ADOPTED this 17th day of May, 19• .
