RESOLUTION NO. 2271
A —RESOLUTIO I OF 714E1 -GI TT QF” VEBEACH,
FLORIDA, VACATING A PORTION OF THE PUBLIC
ALLEYWAY CONNECTING MICHIGAN AVENUE AND
JEFFERSON AVENUE IN BLOCK 48, LINCOLN SUB-
DIVISION, ACCORDING TO A PLAT RECORDED IN
PLAT BOOK NO. 9 AT PAGE 69, OF THE PUBLIC
RECORDS OF DADE COUNTY, FLORIDA, AND GRANT-
ING SUCH VACATED PORTION THEREOF TO LINCOLN-
MICHIGAN COMPANY, INCORPORATED, A FLORIDA
CORPORATION, THEIR SUCCESSORS AND ASSIGNS .
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
MIAMI BEACH, FLORIDA, That that portion of the north
side of the public alleyway connecting Michigan Avenue
and Jefferson Avenue in Block 48 of Lincoln Subdivision,
being immediately south of and adjacent to Lots 11 and
12 of said Block 48, and which is a strip along said al-
leyway in the shape of a right angle triangle, the north-
erly line of said triangle being the south line of said
Lots 11 and 12, the westerly side of said triangle being
a line extended southerly from the southwest corner of
said Lot 12 a distance of Twenty-three Hundredths ( .23)
of a foot, and the hypotenuse of said triangle being a
line connecting the southerly end of said westerly side
of said triangle with the southeast corner of said Lot
11, be and the same is hereby granted to the Lincoln-
Michigan Company, Incorporated, a Florida, Corporation,
their successors and assigns, subject to the proviso
hereinafter contained.
PROVIDED, HOWEVER, that if the building now on
said premises and covering the above described land is
ever moved, demolished, destroyed by fire or rebuilt,
then the above vacation of said portion of said alley-
way and the grant of the use of the same shall be im- _
mediately revoked, terminated and absolutely voided
without any action on the part of the City Council of
the City of Miami Beach, Florida, and said lands above
described shall again become a. portion of said alley-
way for 'the public use .
