RESOLUTION NO. 2253
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA,
VACATING A PORTION OF THE INTERSEC-
TION OF MICHIGAN AVENUE AND LINCOLN
ROAD AND GRANTING SUCH VACATED POR-
TION THEREOF TO FARBER BURBRIDGE,
HIS HEIRS AND ASSIGNS.
WHEREAS, it appears from a survey made by the
W. E. Brown Engineering Company, Incorporated, Miami
Beach, Florida, of Lot 1 in Block 37, of Commercial
Subdivision, according to a plat recorded in Plat
Book No. 6 at Page 5, of the Public Records of Dade
County, Florida, that a portion of the building
thereon projects over the circular southwest corner
of said lot into the intersection of Michigan Avenue
and Lincoln Road, as shown on a plat of said proper-
ty prepared by the said W. E. Brown Engineering Com-
pany, Incorporated, copy of which is attached hereto
and made a part of this resolution,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, That that
portion of the intersection of Michigan Avenue and
Lincoln Road encroached upon or occupied by a portion
of the present building erected on the above described
land, and as shown by the attached survey plat above
referred to, be and it is hereby vacated and the use
of such vacated portion of said intersection be and
the same is hereby granted to Farber Burbridge, his
heirs and assigns, subject to the proviso hereinafter
contained.
PROVIDED, HOWEVER, That if the building now on
said premises and covering the above described land
is ever moved, demolished, destroyed by fire or re-
built , then the above vacation of said portion of
said intersection and the grant of the use of the same
shall be immediately revoked, terminated and absolute-
ly voided without any action on the part of the City
Council of the City of Miami Beach, Florida., and said
lands above described shall again become a portion of
said intersection of Michigan Avenue and Lincoln Road
for the public use.
