A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA,
VACATING A PORTION OF WASHINGTON AVE-
NUE AND A PORTION OF 14TH STREET AND
GRANTING SUCH VACATED PORTIONS THEREOF
TO FARBER BURBRIDGE, HIS HEIRS AND
ASSIGNS .
WHEREAS, it appears from a survey made by the
W. E. Brown Engineering Company, Incorporated, Miami
Beach, Florida, of Lots 15 and 16 in Block 27, of
Ocean Beach Addition No. 2, according to a plat re-
corded in Plat Book No. 2, Page 56, of the Public Re-
cords of Dade County, Florida, that portions of the
building thereon project beyond the property lines
into Washington Avenue not exceeding Thirteen-Hun-
dredths (0.13) feet, and into 14th Street not exceed-
ing Seventeen-Hundredths (0.17) feet, as shown on a
plat of said property prepared by the said W. E. Brown
Engineering Company, Incorporated, copy of which is
attached hereto and made a part of this resolution,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, That that
portion of Washington Avenue and that portion of 14th
Street encroached upon or occupied by portions of the
present building erected on the above described lots,
and as shown by the attached survey plat above referred
to, be and they are hereby vacated, and the use of such
vacated portions of said Washington Avenue and said
14th Street be and the same is hereby granted to Farber
Burbridge, his heirs and assigns, subject to the proviso
hereinafter contained.
PROVIDED, HOWEVER, That if the building now on
said premises and covering the above described land is
ever moved, demolished, destroyed by fire or rebuilt,
then the above vacation of said portion of said Wash-
ington Avenue and said portion of 14th Street and the
grant of the use of the same shall be immediately re-
voked, terminated and absolutely voided without any
action on the part of the City Council of the City of
Miami Beach, Florida, and said lands above described
shall again become portions of said Washington Avenue
and said 14th Street for the public use.
