A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF MIALU BEACH, FLOR-
IDA, VACATING A PORTION OF TENTH
STREET AND GRANTING SUCH VACATED
PORTION THEREOF TO THE OWNER OF
RECORD, HIS HEIRS AND ASSIGNS.
WHEREAS, it appears from a survey made by the
Giersch Engineering Company of Miami , Florida, of
Lots 1, 2 and 3, Block 61, Ocean Beach Addition #3,
according to a Plat recorded in Plat Book No. 2 at
Page 81 of the Public Records of Dade County, Flor-
ida, that a. portion of the building thereon projects
over the north line of said Lot 1 into Tenth Street
from 0.15 Ft . to .2 Ft. as shown on a plat of said
property prepared by the said Giersch Engineering
Co. , copy of which is attached hereto and made a
part of this resolution,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUN-
CIL OF THE CITY OF MIAMI BEACH, FLORIDA, That that
portion of Tenth Street encroached upon or occupied
by a portion of the present building erected on the
above described land, and as shown by the attached
survey plat above referred to, be and it is hereby
vacated and the use of such vacated portion of said
street be and the same is hereby granted to the owner
of the above described property of record on the date
of the passage of this resolution, his heirs and as-
signs, subject to the proviso hereinafter contained.
PROVIDED, HOWEVER, That if the building now on
said premises and covering the above described land
is ever moved, demolished, destroyed by fire or re-
built, then the above vacation of said portion of said
Tenth Street andthe grant of the use of the same shall
be immediately revoked, terminated and absolutely void-
ed without any action on the part of the City Council
of the City of Miami Beach, Florida, and said lands
above described shall again become a portion of said
Tenth Street for the public use.
PASSED AND ADOPTED this 17th day of September, A. D.
1930.
