Resolution 2465 lawasimismw RESOLUTION NO. 2465 WHEREAS, the City Council of the City of Miami Beach, Florida, upon its own initiative deems it ad- visable to consider the amending, supplementing, changing, modifying and/or repealing of the regula- tions, restrictions and/or boundaries, as provided in Ordinance No. 289, commonly known as the Zoning Ordinance of Miami Beach, Florida, as hereinafter set forth, to-wit: I. That Section 1 of Ordinance No. 289 be amended so that the paragraph therein designated "Yard, Front: " be changed to read as follows: "Yard, Front: An unoccupied area between the front property line (either street or bulk- head of any waterway) and the front line of any main or accessory building, measured at its least dimension and extending from one side yard to the other, exclusive of steps and open terraces. " II. That Section 17 of said Ordinance No. 289 be amended by adding thereto the following para- graphs: " (G) In the "RE" Districts, open balconies , at and/or above the second floor, may be con- structed in the side yard on the street side of a corner lot. (H) In the "RE" Districts, steps extending not more than four (4) feet from the main building, leading to the basement or ground floor may be constructed in the side yard on the street side of a corner lot. (J) On lots fifty (50) feet, or less, in width, a porte-cochere which is not more than eighteen (18) feet in length may project over any side or rear yard, provided however, that such porte-cochere does not exceed one (1) story in height, and that the supporting col- umns shall not exceed two (2) feet in any cross-section dimension. " III. That in the area bounded on the North by the south line of Lot "A" INDIAN BEACH CORPORATION'S SUBDIVISION as recorded in Plat Book 8 on Page 61 of the Public Records of Dade County, Florida, on the South by the south lines of FISHER''S FIRST SUBDIVISION OF ALTON BEACH as recorded in Plat Book 2 on Page 77 of the Public Records of said County, on the West by Collins Avenue and on the East by the Atlantic Ocean, walls may be erected, constructed, reconstructed, or structurally altered on the lot lines not to exceed seven (7) feet in height. IV. That Lots Sixteen (16) to Twenty (20) both inclu- sive of Block Fifteen-B (15-B) , AMENDED PLAT OF SUNSET LAKE SUBDIVISION as recorded in Plat Book 8 on Page 52 of the Public Records of Dade County, Flo , be changed from Area District Seven (7) Dis- trict to Area Five (5) . V. That Section 7 of said Ordinance No. 289 be amend- ed by inserting therein after theMeawords "grocery stores" the following words: ts. " VI. That sub-paragraph "a" of paragraph 6 of d toread n 15 of said Ordinance No 29 be as follows: "a. Single family, 5600 square feet of lot area per family. " NOPT, THEREFORE, BE IT RESOLVEDSeptember,thrpublic ic1 hearing be called for the 2nd day at 10:00 o'clock A. M. , in the Council Chamberat the City Hall, Miami Beach, Florida, for the purposes as above set forth, and BE IT FURTHER RESOLVED, that notice of the time, place and object of such hearing be published as is provided by said Ordinance No. 289. PASSED AND ADOPTED this 5th day of August , A.D. 1931.
