A RESOLUTION OF THE CITY OF MIAMI BEACH,
FLORIDA, VACATING A PORTION OF ALLEY,
IMMEDIATELY WEST OF LOT 3, BLOCK 71,
OCEAN BEACH FLORIDA ADDITION NO. 3 , AC-
CORDING TO THE PLAT THEREOF, RECORDED IN
PLAT BOOK 2, AT PAGE 81, OF THE PUBLIC
RECORDS OF DADE COUNTY FLORIDA, AND GRANT-
ING SUCH VACATED PORTION THEREOF TO KATE
POLLAK HER HEIRS, SUCCESSORS, DEVISEES OR
ASSIGNS.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
MIAMI BEACH, FLORIDA:
SECTION 1: That that portion of the alley-way extend-
ing North and South through Block 71, as
shown on plat of Ocean Beach, Florida, Addition No. 3
encroached upon by apartment building located on Lot 2, •
Block 71 of said Ocean Beach, Florida, Addition No. 3,
being approximately seven hundredths of one foot in
width, immediately west of and adjacent to said Lot 3,
be and the same is hereby vacated and the use of such
vacated portion of said alley-way be and the same is
hereby granted to Kate Pollak, her heirs, personal re-
presentatives or assigns, subject to the proviso here-
inafter contained.
PROVIDED, HOWEVER, that if the building
now on said premises and coveing the above descried
strip of land is ever moved, demolished, destroyed by
fire or rebuilt, then the above vacation of said por-
tion of said alley-way and the grant of the use of the
same shall be immediately revoked, terminated and ab-
da voided without any action on the part of the
City Council of the City of Miami Beach, Florida, and
said lands above described shall again become a por-
tion of alley-way for the public use.
PASSED AND ADOPTED this 1st day of June,
