Resolution 2544 RESOLUTION NO. 254+
WHEREAS, on the 16th day of December, A. D. 1931,
the City of Miami Beach entered into a contract of pur-
chase with John B. Reid and Company, a Florida Corpora-
tion, as authorized agent for the owners of certain
property known and described as Block 114 of Ocean Beach
Addition No. 4, together with all riparian rights apper-
taining thereto, as recorded and shown in Plat Book 3 at
Page 151 of the Public Records of Dade County, Florida,
at and for the sum of Eighty Thousand Dollars ($80,000.00)
to be paid as therein set forth, and,
WHEREAS, said contract expressly provided that said
contract was made and entered into subject to all require-
ments and provisions of Section 26 of the City Charter of
the City of Miami Beach, as amended in 1925, and,
WHEREAS, afterwards, within forty (40) days of the
execution of said contract,, petitions signed by qualified
electors of the City in number equal to ten per cent (10%)
of the registration of said City were filed with the City
Clerk, asking that said measure and the resolution author-
izing same be submitted to the electorate of said City,
and,
WHEREAS, said Section 26 of said City Charter pro-
vides that upon the filing of such a petition as above
set forth such ordinance or measure must be either repealed
or submitted to the electors for approval or rejection as
therein set forth, and,
WHEREAS, the City Council is of the opinion that due
to the present financial condition of said City it is to
the best interests of said City that said contract and the
resolution authorizing the execution of same be repealed
and rescinded,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, That in consideration
of the above it is hereby ordered and declared that the
contract to purchase hereinbefore referred to, and the
resolution authorizing same hereinbefore mentioned be and
the same are hereby repealed and cancelled, and shall
from this date henceforth be null and void and of no effect.
