Ordinance 96-3032 ORDINANCE NO. 96-3032 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING MIAMI BEACH CITY CODE CHAPTER 4A, ENTITLED "ART IN PUBLIC PLACES", AMENDING SECTION 4A-6, ENTITLED "ART IN PUBLIC PLACES COMMITTEE (APPC) " , BY INCREASING THE MEMBERS ON THE COMMITTEE FROM SIX (6) TO SEVEN (7) MEMBERS; PROVIDING FOR A REPEALER„ SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, the Art in Public Places Committee ( "Committee" ) was established to carry out various functions and duties to assist in the placement of art in public places throughout the City of Miami Beach to enrich the City' s aesthetic environment; and WHEREAS, in order to expedite voting decisions, the current even number of six (6) Committee members should be increased to seven (7) members . NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF TIM CITY OF MIAMI BEACH, FLORIDA: SECTION 1 . AMENDMENT OF SECTION 4A-6 . That Section 4A-6 , entitled "Art in Public Places Committee ( "APPC" ) " , of Miami Beach City Code Chapter 4A, entitled "Art in Public Places" is hereby amended as follows : } Section 4A-6 . Art in Public Places Committee (APPC) . (a) An Art in Public Places Committee (APPC) is hereby established to carry out the functions and duties set forth in Section 4A-7 . The Committee shall be composed of aix (G) seven (7) members appointed by a majority vote of the entire City Commission. The members shall possess a high degree of competence in the evaluation of art history, architectural history, art, architecture, sculpture, painting, artistic structural design and other appropriate media for display or integration of Art in Public Places . SECTION 2 . REPEALER. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 3 . SEVERABILITY. If any section, subsection, clause or provision of this Ordinance is held invalid, the remainder shall not be affected by such invalidity. 2 SECTION 4 . CODIFICATION. It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is hereby ordained that the provisions of this ordinance shall become and be made a part of the Code of the City of Miami Beach, Florida. The sections of this ordinance may be renumbered or relettered to accomplish such intention, and the word "ordinance" may be changed to "section" , "article, " or other appropriate word. SECTION 5 . EFFECTIVE DATE. This Ordinance shall take effect on the 3rd day of February , 1996 . ADMINISTRATION RECOMMENDATION: To adopt the proposed amendment to Ordinance No. 95-2985, Section 4A-6 on second and final reading. BACKGROUND: The Art in Public Places Committee was established in order to enhance the aesthetic environment of the City of Miami Beach on public property and City construction projects. Currently the Committee is composed of six members and is concerned about a majority vote. The Committee believes the addition of one member would eliminate situations in which a majority vote could not be reached. The increased membership would also provide a greater probability of a quorum at each meeting. This Ordinance was approved on first reading January 10, 1996. CONCLUSION: That the City Commission approve the Amendment to Ordinance No. 95-2985, Section 4A-6.
