Resolution 2616 RESOLUTION NO. 2616
WHEREAS, during the years 1927 and 1925 the City Council
and City officials made an effort to obtain easement strips
from the East end of lots fronting on Ocean Drive between Sixth
Street and Fourteenth Lane for the purpose of widening said
Ocean Drive, and
WHEREAS, an insufficient number of property owners con-
cerned saw fit to execute the necessary easements which fact
resulted in the City Council abandoning their effort to effect
the proposed street widening, and
WHEREAS, in connection with said effort there was filed
with the City Engineer of the City of Miami Beach the two fol-
lowing described instruments to-wit:
Dedication for street widening of Ocean Drive
dedicating the East 15 feet of Lot 5 of Block
13 of Ocean Beach Addition No. 1, as per Plat
recorded in Plat Book No. 3, Page 11 of the
Public Records of Dade County, Florida, said in-
strument being dated December 2nd, 1927 and signed
by Hermione Cushman and Burritt A. Cushman, as
joint owners of said property; and a similar in-
complete instrument purporting to dedicate the
East 15 feet of the said Lot 5 of Block 13, of
Ocean Beach Addition No. 1, under date of November
23rd, 1927, signed by E. J. White, erroneously in-
dicated in one instance as the Lienor and in the
other instance as the owner of said Lot 5.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA, that the City Clerk be autho-
rized to return the two above described instruments to the
present owner of record of said Lot 5, Block 13, after inscrib-
ing thereon a notation to the effect that the City of Miami
Beach does not accept the dedication of the property described
in said instruments and that said dedications are thereby can-
` celled and annulled to the same extent as though said instru-
ments of dedication had never been executed.
