AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA,AMENDING MIAMI BEACH CITY
CODE CHAPTER 14, ENTITLED "FIRE PREVENTION",BY AMENDING
SECTION 14-2 THEREOF,ENTITLED"ADOPTION BY REFERENCE",BY
ADOPTING THE 1991 EDITION OF THE NATIONAL FIRE PROTECTION
ASSOCIATION LIFE SAFETY CODE AS TO ALL BUILDINGS AND
STRUCTURES; PROVIDING FOR A REPEALER, SEVERABILITY AND
AN EFFECTIVE DATE.
WHEREAS,Miami Beach City Code Section 14-2 presently adopts the 1991 edition of the National
Fire Protection Association Life Safety Code (1991 Code) as to new buildings and structures, but
not as to existing buildings and structures; and
WHEREAS, the adoption of the 1991 Code as to all buildings and structures would protect the
health, safety, and welfare of the citizens of Miami Beach; and
WHEREAS, it is necessary to amend Miami Beach City Code Section 14-2 in order to adopt the
1991 Code as to all buildings and structures; and
WHEREAS, the City of Miami Beach is preparing a Financial and Loan Program to make it
available to affected property owners to facilitate the implementation of this Ordinance; and
WHEREAS,it would be in the best interest of the City and of those affected by this Ordinance that
this Ordinance becomes effective when the Financial and Loan Program is approved by the City
Commission.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA:
Section 1. Amendment of City Code Section 14-2 .
That Section 14-2 of Miami Beach City Code Chapter 14, entitled
"Fire Prevention" is hereby amended as follows:
Section 14.2 Adoption by reference.
The National Fire Protection Association (NFPA) 101, Life Safety Code,
1991 edition is hereby adopted by reference as to new buildings or structures as if
fully set forth herein,as said Code may be amended from time to time. The National
Firc Protection Association (NFPA) 101, Life Safety Code, 1985 edition is hereby
adopted by reference as to existing buildings or structures as if more fully set forth
herein. New and existing buildings or structures shall be defined as in Section
Section 2. Repealer.
All ordinances or parts of ordinances in conflict herewith be and the same are
hereby repealed.
Section 3. Severability.
If any section, subsection, clause, or provision of this Ordinance as is held
invalid, the remainder shall not be affected by such invalidity.
Section 4. Effective Date.
This Ordinance shall take effect on the 1st day of October, 1996.

ADOPT THE 1991 EDITION(SPECIFICALLY THE SECTION REQUIRING THE
INSTALLATION OF SPRINKLER SYSTEMS) OF THE NATIONAL FIRE
PROTECTION ASSOCIATION LIFE SAFETY CODE AS TO ALL BUILDINGS
AND STRUCTURES
ADMINISTRATION RECOMMENDATION:
The Administration recommends the Mayor and City Commission adopt the attached ordinance adopting the 1991
edition of the National Fire Protection Association Life Safety Code as to all buildings and structures,effective upon
passage of a Resolution establishing a financing plan to assist owners in complying with the requirements of the 1991
Code.
BACKGROUND:
In 1992,the Dade County Commission adopted the 1991 Code, and made it effective in the City of Miami Beach
through incorporation by reference on May 24, 1992. On May 3, 1995 the City Commission adopts Resolution No.
95-21569, requesting the City of Miami Beach be exempt from the enforcement of National Fire Protection
Association 1991 Edition Life Safety Code ("the 1991 Code"). On May 17, 1995 the City.Commission adopted
Ordinance No.95-2994,which adopted the 1991 Code as to new buildings or structures and adopted the 1985 Code
for existing buildings or structures.
On June 3, 1996 a report and recommendations were submitted to the City Commission. The report includes the
specifics of the fire of May 24, 1996 at the Morton Towers,a chronology of events with reference to the adoption
of the 1985 and 1991 Codes as it pertains to the installation and retrofitting of high-rise buildings in the City of
Miami Beach,a detailed analysis of the costs to retrofit the buildings, and a recommendation of funding assistance
through the establishment of a loan program.
CONCLUSION:
This ordinance should be approved,adopting of the 1991 Code to all high-rise residential buildings, effective upon
passage of a resolution establishing a financing plan to assist owners in complying with the requirements of the 1991
Code. •
