A RESOLUTION OF THE CITY OF MIAMI BEACH,
FLORIDA, VACATING A PORTION OF T WEST
SIDE OF THE ALLEYWAY TO THE REAR OF AND
ADJACENT TO THE PROPERTY DESCRIBED IN THE
SUCCEEDING PARAGRAPH AND ILLUSTRATED ON
ThM ATTACHED BLUE PRINT, AND GRANTING
SUCH VACATED PORTION TO FRED SCHUSTERBAUER
AND HELEM M. SCHUSTERBAUER, HUSBAND AND WIFE.
A certain parcel of land lying and being in the City of
Miami Beach, County of Dade, State of Florida, described as
follows , to-wit:
Lot Fourteen (14) , of the Subdivision
of Lot Eleven (11) , Block Forty (40) ,
of First Addition to COMMERCIAL SUB-
DIVISION, of Alton Beach, according to
the plat thereof, recorded in Plat
Book 6, at page 165, of the Public
Records of Dade County, Florida.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI
BEACH, FLORIDA:
SECTION 1: THAT the portion of the West side of the alleyway
to the rear of and adjacent to the above described
parcel of land being 0.2 of a foot in width immediate-
ly East and adjacent to the above described property
Ij be, and the same is hereby granted to FRED SCHUSTER-
BAUER and HELEN M. SCHUSTERBAUER, husband and wife , subject to
the proviso hereinafter contained.
PROVIDED, however, that if the building now on said premises
and covering the above described land is ever moved, demolished,
destroyed by fire , or rebuilt , then the above vacation of said
portion of said alleyway and the grant of the use of the same
shall immediately be revoked, terminated, and absolutely voided
without any action on the part of the City Council of the City
of Miami Beach, Florida, and said lands above described shall
again become a portion of the said alleyway for the public use.
