2002-24867 Reso RESOLUTION NO. 2002-24867 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING, SUBJECT TO FINAL APPROVAL OF SAME BY THE AUTHORIZED OFFICIALS IN MIAMI- DADE COUNTY, THE PROPOSED FINAL PLAT OF "AQUA AT ALLISON ISLAND", A SUBDIVISION OF A PORTION OF ALLISON ISLAND, AN ISLAND IN INDIAN CREEK, BETWEEN GOVERNMENT LOT 6 AND GOVERNMENT LOT 7, SECTIONS 11 AND 14, TOWNSmp 53 SOUTH, RANGE 42 EAST. WHEREAS, 63rd Street Associates, Ltd., a Florida Corporation, is the Owner of a portion of Allison Island, an island in Indian Creek between Government Lot 6 and Government Lot 7, Sections 11 and 14, Township 53 South, Range 42 East, located in the City of Miami Beach, Miami-Dade County, Florida (the Property); and WHEREAS, the Owner is planning to develop the Property into multiple apartment buildings and townhouses with private access roads and utility easements; and WHEREAS, to provide individual ownership of portions of the Property it is necessary to subdivide the Property and record the Subdivision in a Plat; and WHEREAS, such a Tentative Plat named "Aqua at Allison Island" has been submitted, reviewed and approved by the City's Planning, Building, and Public Works Departments, and by Miami-Dade County; and WHEREAS, the Final Plat of "Aqua at Allison Island" (Exhibit A) is herein submitted for acceptance by the City Commission, subject to fmal approval of same by the appropriately authorized officials in Miami-Dade County, for approval. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein accept, subject to final approval of same by the authorized officials in Miami- Dade County, the proposed final plat of" Aqua at Allison Island", a Subdivision of a portion of Allison Island, an island in Indian Creek between Government Lot 6 and Government Lot 7, Sections 11 and 14, Township 53 South, Range 42 East, located in the City of Miami Beach, Miami-Dade County, Florida, together with all the noted dedications and easements therein. Issue: Shall the City accept the final plat subdividing this tract of land? Item Summary/Recommendation: 63rd Street Associates purchased the southern portion of Allison Island, which used to accommodate St. Francis Hospital. 63rd Street Associates plan to develop it into a mixed residential and commercial project which has been referred to as the Aqua development. In 1999 the City re-zoned this district to allow the use of this property for low-rise townhouses, mid-rise apartment buildings and a limited commercial development. To allow individual ownership of the townhouses the developer has elected to subdivide this tract of land into the proposed Plat. Since the proposed final Plat is consistent with the City's plan and order, the State Statutes and the County Code, the City Commission approval is largely an administrative action. ADMINISTRATION RECOMMENDATION Adopt the Resolution. BACKGROUND The north portion of Allison Island in Indian Creek at 63rd Street, was platted in May 1930. The portion of the island south of 63rd Street, was occupied by St. Francis Hospital, the first hospital on Miami Beach constructed in 1925. This tract of land, approximately 8.5 acres, was purchased in 1999 by the 63rd Street Associates, Ltd., a Florida Corporation, who planned to develop the site into a residential and commercial project. In order to do this, the developer made application to the City of Miami Beach to change future land use map designation for this property, from PF-RHO Public Facility (Religious, Hospital, Other) to RM-PRD Residential Multi-family Planned Residential Development. The developer also applied for an amendment to the text of the City of Miami Beach Comprehensive Plan which would allow limited accessory commercial development in the RM-PRD Residential Multi Family Planned Residential Development future land use category. On December 15, 1999, Ordinance # 99-3227 was adopted amending the future land use of this property to RM-PRD zoning, together with Ordinance #99-3228 amending the Goals, Objectives and Policies of the RM-PRD zoning district. Since the developer is planning to build new low rise townhouse units and mid-rise apartments with individual ownerships and common access roads, they have elected to subdivide the property into individual lots and parcels, which required platting of this tract. ANALYSIS A Tentative Plat of the "Aqua" was submitted to the City and Miami-Dade County in May of 2001. Several issues, including proposed utilities, easements, access roads, street names and numbering, were discussed and required to be resolved by the developer prior to final resubmittal of the plat to the City. The final plat was resubmitted after addressing the above issues. The City's Public Works Department, together with Planning, Building and Code Compliance Departments have reviewed the proposed plat, and approved it. The Plat will be maintaining all the streets within the subdivision as private streets, which will be named eventually. The naming of private streets does not require City or County approvals. Tracts "I", designated as such in the plat (see attached Exhibit "A"), are being dedicated as utility easements for the installation of water and sewer mains, and power, telephone, gas and cable distribution system. The restoration and maintenance of these areas will be by the Homeowners Association. The Plat also restricts the installation of all electrical and communications cables underground. All the water and sewer mains within the proposed subdivision are being constructed by the developer and will be conveyed to the City upon completion. The City will be installing separate meters to the individual townhomes and buildings, and shall bill the residents accordingly. An Opinion of Title, dated April 16, 2002 has been submitted and the Plat reflects the stated ownership and mortgage holders as shown. The Plat also dedicates to the public a tract on the south side of 63rd Street for a right turn lane into the development. CONCLUSION Since the proposed final Plat is consistent with the City's plan and order, the State Statutes and the County Code, the City Commission approval is largely and administrative action.
