AN ORDINANCE OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA, AMENDING MIAMI BEACH CITY CODE
CHAPTER 45, ENTITLED "WATER", AMENDING SECTION
45-4, ENTITLED "SCHEDULE OF RATES AND TAPPING
CHARGES", BY DELETING THE REFERENCE TO THE
METER RATE TO NON-MUNICIPAL CONSUMERS, BY
DELETING THE REFERENCE TO THE WATER SUPPLY
RATE TO A MUNICIPALITY, BY CHANGING THE RATES
CHARGED BY THE CITY FOR WATER SUPPLY SERVICE,
EFFECTIVE FOR METER READINGS TAKEN ON OR
AFTER OCTOBER 5, 1996, AND BY CHANGING THE
MINIMUM MONTHLY CHARGE FOR SUCH SERVICE;
PROVIDING FOR A REPEALER, SEVERABILITY AND AN
EFFECTIVE DATE.
WHEREAS, the City of Miami Beach purchases water from the Miami Dade Water and
Sewer Department for resale to its consumers; and
WHEREAS, the Miami Dade Water and Sewer Department will be increasing the
wholesale water rate for the fiscal year, beginning October 1, 1996; and
WHEREAS, it is necessary to pass this rate increase on to the consumers.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA as follows:
SECTION 1: Section 45-4 of Chapter 45, entitled "Water," of the Code of the City of Miami
Beach, Florida, is hereby amended as follows:

SECTION 4: EFFECTIVE DATE. This Ordinance shall take effect on the 5th day of
October , 1996, which is 10 days after its adoption.

{ )(a) Every water supply service shall have a monthly minimum service charge
on each service installed, varying with and based upon the size of the service
pipe required and installed in accordance with the rules of the Public Works
Department. This minimum charge shall be in accordance with the following
schedule and shall entitle the consumer, without cxccss chargc, to have supplied
through the meter the number of gallons of water set forth in the table.

There shall not be a rental charge on meters,
e(b) For quantities of water supplied in excess of the amount set forth in
subsection (a) above based on the particular size of the service pipe,—Tthe water
rate shall incrcasc from $1.22 be $1.51 per thousand gallons, which rate shall
be prorated for each hundred gallons in the event of increments of less than one
thousand gallons, to $1.40 per thousand gallons from Junc 1, through
November 30, and incrcasc from $1.37 per thousand gallons to $1.64 per
thousand gallons from Dcccmbcr 1, through May 31, for non-municipal
consumers of water as set forth in Scction 1 of this Ordinance and shall be
applied to all water billings bascd on mctcr readings takcn on or after Junc 1,

(c) The rates and charges provided in this Section shall be and become effective
and binding on October 5, 1996.
SECTION 2: REPEALER. All ordinances or parts of ordinances in conflict herewith be and
the same are hereby repealed.
SECTION 3: SEVERABILITY. If any section, subsection, sentence, clause, phrase or
portion of this Ordinance is, for any reason, held invalid or unconstitutional,
such portion shall be deemed a separate, distinct and independent provision and
such holding shall not affect the validity or constitutionality of the remaining
portions of this Ordinance.

WATER SUPPLY SERVICE; AND TO ADJUST THE MINIMUM
MONTHLY CHARGE FOR SUCH SERVICE IN ORDER TO PASS
THROUGH THE RATE CHANGE BY THE MIAMI-DADE WATER AND
SEWER DEPARTMENT
ADMINISTRATION RECOMMENDATION:
The administration recommends that the city commission adopt an ordinance amending Chapter
45, Section 45-4 of the Miami Beach City Code to 1) change the rate for water supply service;
2) adjust the schedule of rates for the minimum monthly service charge for water supply service;
3) delete references to the meter rate for non-municipal consumers and the water rate to
municipalities.
BACKGROUND
The Miami-Dade Water and Sewer Department will be decreasing the wholesale water rate for
the 1996/97 fiscal year and it is necessary for the City of Miami Beach to adjust the rates to be
passed on to the consumer.
ANALYSIS
The wholesale water rate to be charged by the Miami-Dade Water and Sewer Department is
$0.6688 per one thousand gallons. There will be no differentiation between wet and dry seasons
with respect to wholesale water rates charged by the Miami-Dade Water and Sewer Department.
Similarly, the city will charge to its consumers the same rate for both the wet and dry seasons.
The new wholesale rate results in a net decrease of$0.02 per 1,000 gallons to the consumer. The
rate of$1.51 per thousand gallons for water supply service includes administrative and operating
costs for the city as well a seven and one half percent Department of Environmental Resource
Management fee. The ordinance also provides for adjustments to the minimum monthly service

charge for each water supply service to reflect the wholesale rate change.
Additionally, this ordinance provides for the deletion of references to metered rates to non-
- municipal consumers and water rates to municipalities which are no longer applicable. The water
rate charged for water supply is based on meter readings. As of January, 1996, the city no longer
provides water supply service to other municipalities.
CONCLUSION
The change in the water rate included in this ordinance reflects the decrease in the wholesale rate
charged by the Miami-Dade Water and Sewer Department to municipal users and results in an
erall annual decrease to the average user.
