AN ORDINANCE OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA, AMENDING MIAMI BEACH CITY CODE
CHAPTER 45, ENTITLED, "WATER", AMENDING
SECTION 45-20.2, ENTITLED "SANITARY SEWER
SERVICE CHARGE", BY INCREASING THE SANITARY
SEWER SERVICE CHARGE IMPOSED BY THE CITY UPON
ALL PREMISES CONNECTED TO OR USING THE CITY'S
SANITARY SEWER SYSTEM FROM TWO DOLLARS AND
SEVENTY-FOUR CENTS PER THOUSAND GALLONS TO
THREE DOLLARS PER THOUSAND GALLONS;
PROVIDING FOR A REPEALER, SEVERABILITY, AND AN
EFFECTIVE DATE.
WHEREAS, the City of Miami Beach pays the Miami-Dade Water and Sewer Department
a fee for the treatment of sewerage; and
WHEREAS, the Miami Dade Water and Sewer Department will be increasing the
wholesale sewer rate for the fiscal year, beginning October 1, 1996; and
WHEREAS, it is necessary to pass this rate increase on to the consumers.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA as follows:
SECTION 11 Section 45-20.2 of Miami Beach City Code Chapter 45, entitled "Water", is hereby
amended to read as follows:
Sec. 45-20.2. Sanitary sewer service charge.
There is hereby imposed, upon all premises within the city connected to or using the
facilities of the city's sanitary sewer system, a monthly sanitary sewer service charge.
Such sanitary sewer service charge shall be in an amount equal to
four ccnts three dollars per thousand gallons of water delivered to the consumerwhich
charge shall be prorated for each hundred gallons in the event of increments of less than
one thousand gallons. as shown by the water bills rendered in accordance with this
Gchapter. The sanitary sewer service charge shall be and become effective and binding

1996. The amount of such sanitary sewer service charge shall be shown as a separate item
on such water bills and shall be paid by the owner, tenant or occupant in possession of
such premises at the same time and in the same manner as is provided in this chapter for

may file (between October 1; and September 307 of each year) an affidavit on the form
prescribed by the City, stating that water was used regularly for sprinkling or for other
purposes that did not enter the sanitary sewer system during the preceding fiscal year
October 17 through September 30). Upon verification by a representative of the City, the
customer shall receive a credit equal to six percent of the total amount of sanitary sewer
service charges paid by the customer during the preceding year. Further provided, that
the provisions of this section shall not be applicable to any water sold and delivered
through separate meters measuring water delivered and consumed solely for swimming
pools, lawn sprinkler systems or other purposes not requiring the use of sanitary sewer
system facilities of the City.
SECTION 2. REPEALER.
All ordinances or parts of ordinances in conflict herewith be and the same are hereby
repealed.
SECTION 3. SEVERABILITY.
If any section, subsection, sentence, clause, phrase or portion of this Ordinance is, for any
reason, held invalid or unconstitutional, such portion shall be deemed a separate, distinct and
independent provision and such holding shall not affect the validity or constitutionality of the
remaining portions of this Ordinance.
SECTION 4. EFFECTIVE DATE.
This Ordinance shall take effect on the 5th day of October , 1996, which is
10 days after its adoption.

ADMINISTRATION RECOMMENDATION:
The administration recommends that the city commission adopt the attached ordinance amending
Chapter 45, Section 45-20.2 to increase the sanitary sewer service charge imposed by the city
upon all premises connected to or using the city's sanitary sewer system from two dollars and
seventy-four cents ($2.74) per thousand gallons to three dollars ($3.00) per thousand gallons.
BACKGROUND
The Miami-Dade Water and Sewer Authority is increasing the volume sewer customer rates for
the fiscal year beginning October 1, 1996. The City of Miami Beach, as a volume user customer,
is subject to periodic rate increases in accordance with the contract with the Miami-Dade Water
and Sewer Department. In order for the city to recover the increases, they are passed through to
the retail users.
ANALYSIS
On June 5, 1996, the City of Miami Beach was notified by the Miami-Dade Water and Sewer
Department that the volume sewer customer rates would increase from the present rate of$1.4719
per thousand gallons to an annualized average rate of$1.6253 per thousand gallons.The result
is an average increase of $0.15 per thousand gallons or a 10 percent increase over the current
wholesale rate. The $0.26 increase by the city includes the $0.15 increase in the wholesale rate
and an $0.11 increase for the seven and one half percent Environmental Resource Management
Department fee.

The average wholesale rate consists of a dry season rate (December 1 to May 31) of$1.8059, and
a wet season rate (June 1 to November 30) of$1.4447. The wet season rate includes a twenty-five
percent infiltration/inflow surcharge to encourage reduction of storm water and ground water
infiltration and inflow into the sanitary sewer system. The city has recently implemented a three
year Sanitary Sewer Infiltration and Inflow Mitigation Program which will result in substantial
savings in sewage treatment costs. It is estimated that the first year of this program will result i
savings of$one million by the city from fees paid to Dade County.
CONCLUSION:
The sanitary sewer service charge reflects the wholesale rate increase by the Miami-Dade ater
and Sewer Department to municipal users as well as an increase for the Environmental Rei ource
Management Department fee.
