A RESOLUTION OF THE CITY OF MIAMI
BEACH, FLORIDA, GRANTING PERMISSION
FOR THE EXTENSION OF THE ORNAMENTAL
SECOND FLOOR BALCONIES OF THE BUILD-
F ING SITUATED ON THE HEREINAFTER DES-
CRIBFr) PROPERTY, AS INDICATED BY
AND ILLUSTRATED ON THE ATTACHED BLUE
PRINT, PREPARED BY RICHARD F. GIERSCH,
JR. , CIVIL ENGINEER.
That certain lot or parcel of land situate, lying and
being in the City of Miami Beach, County of Dade, State of Florida,
described as follows, to-wit:
The East 44.46 feet of Lot 5 and the
West 6.0 feet of Lot 4 of Block 31
of Fisher's First Subdivision of Al-
ton Beach, according to plat thereof
recorded in Plat Book 2, page 77 of
the Public Records of Dade County,
Florida,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI
BEACH, FLORIDA:
SECTION 1: That the extention of the ornamental second floor
balconies of the building situated on the above
described property, as shown by the attached blue
print, be permitted and all right,to object to said
encroachment as it presently exists, is hereby waived,
subject to the proviso hereinafter contained and set
forth,
PROVIDED, however, that if the building now situated on said pre-
mises and covering the hereinabove described land is moved, de-
molished, destroyed by fire or rebuilt, then and in that event,
the permission allowing said encroachment to exist, and the waiver
of right to object to said encroachment as it presently exists,
shall be automatically revoked and made absolutely void without
any action on the part of the City Council of the City of Miami
Beach, Florida.
PASSED AND ADOPTED, this 4th day of April, A. D. 1934.
