A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA,
VACATING A PORTION OF TWELFTH STREET
AND A PORTION OF A PUBLIC ALLEY NOW
ENCROACHED UPON BY AN EXISTING BUILD-
ING SITUATED ON THE HEREINAFTER DE-
SCRIBED PROPERTY, AS INDICATED BY AND
ILLUSTRATED ON THE ATTACHED BLUE PRINT
PREPARED FOR NEW YORK TITLE & MORTGAGE
COMPANY BY RICHARD F. GIERSCH, JR. ,
REGISTERED ENGINEER.
Lots 7 and 8 in Block 64 of Ocean Beach Addition
No. 3, as shown on a plat recorded in Plat Book
2 at Page 81 of the Public Records of Dade County,
Florida.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
Section 1: That the portion of Twelfth Street immediately South
of, and the portion of the public alley immediately West of the
above described property on which the existing building is shown
to encroach as indicated and illustrated on a plat prepared for
the New York Title & Mortgage Company by Richard F. Giersch, Jr. ,
Registered Engineer, Miami, Florida, copy of which is attached
hereto and made a part hereof, be and the same is hereby vacated
and all right to object to said encroachment as it presently exists
is hereby waived subject to the proviso hereinafter contained and
set forth:
PROVIDED, however, that if the building now situated on said premises
and covering the hereinabove described land is ever moved, demolished,
destroyed by fire or rebuilt, then, and in that event, the above va-
cation of said portion of Twelfth Street and a public alley, and the
permission allowing the said encroachment to exist, and the waiver
of right to object to said encroachment as it presently exists, shall
be immediately and automatically revoked, terminated and absolutely
voided without any action on the part of the City Council of Miami
Beach, Florida, and said lands above described shall again become
a portion of Twelfth Street and a public alley for the public use.
