BEACH, FLORIJA, GRANTING PERMISSION
FOR THE ENCROACHMENT OF 'EAVES, ORNAMEN-
TAL WORK AND OTHZR PARTS OF A BUILDING
SITUATED ON THE HEREINAFTER DESCRIBED
PROPERTY, OVER A STRIP OF LAND PREVIOUS-
LY QUIT-CLAIMED TO THE SAID CITY OF MIAMI
BEACH FOR STREET AND/OR SIDEWALK PURPOSES,
PARALLEL TO AND ADJOINING ESPANOLA WAY,
SAID ENCROACHMENT AS INDICATED ON THE AT-
TACHED BLUE PRINT PREPARED BY RICHARD F.

That certain lot or parcel of land situate, lying and being
in the City of Miami Beach, County of Dade, State of Floriaa,, de-
scribed as follows, to-wit:
Lots 3 and 4 of Block 4A of First Addition
to hitmants Suouivisioo of Espanola Villas,
as reconied in Plat Book :,1n. 9 at Page 147,
of the Public Records of Dade County, Floriia,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: That the encroachment at present existing, a maximum
of 0.7 feet of eaves, ornamental work and other parts
of a building situated en the above described property,
over a strip of land parallel to and adjoining Espano-
la tiay, formerly quit-claimed to the City of Miami
• soh for street and/or sidewalk purposes, all as
ihown on the attached blue print prepared by Richard
▪ Gierach, Jr. Registered Znc,ineer and Surveyor,
under date of M.;„), 9th, 1934, be and the same is
herewith permitted, and all right to object to said
encroachment as it presently exists, is hereby waived,
subject to the proviso hereinafter contained and set
forth,
PROVIDED, however, that if the building now situated on said pre-
mises and covering the hereinabove described land is moved, demolish-
ed, destroyed by fire or rebuilt, then and in that event, the per-
mission allowing said encroachment to exist, and the waiver of right
to object to said encroachment as it presently exists, shall be auto-
matically revoked and made absolutely void without any action on
the part of the City Council of the City of Miami Beach, Florida.
PASSED AND ADOPTED this 29th day of May, A. D. , 1934.
