Resolution 2936 RESOLUTION NO. 2936 A RESOLUTION EMPLOYING ATTORNEY TO FORE- CLOSE CERTAIN TAX CERTIFICATES HELD BY THE CITY OF MIAMI BEACH TO BE SELECTED BY THE CITY CLERK, TOGETHER WITH ALL SPECIAL AS- SESSMENTS AND OTHER CLAIMS AND DEMANDS HELD BY THE CITY AGAINST THE LANDS COVERED BY THE TAX CERTIFICATES SO SELECTED AND PROVIDING FOR COMPENSATION TO BE PAID SAID ATTORNEY, AND FOR THE PAYMENT OF EXPENSES INCIDENTAL TO THE FORE- CLOSURE. WHEREAS, the City of Miami Beach holds numerous Tax Certifi- cates for delinquent City taxes, and WHEREAS, against the lands covered by such Certificates, or a greater part thereof, the City holds other claims a ndebmands in the nature of taxes, tax certificates, and/or special assessments or installments thereof, and WHEREAS, the City has elected to foreclose all of its Tax Certificates for the year 1930 and prior years, and other claims and demands against the lands covered by said Tax Certificates. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA. Section 1: That the City Clerk is hereby directed and instructed to select such number of Tax Certificates from those owned and held by the City of Miami Beach, as, in his judgment, it may be expedient and convenient to foreclose in one action, and to deliver them over to the Attorney hereinafter named together with all other evidences of in- debtedness held by the City of Miami Beach against the lands covered by the Tax Certificates so to be selected, together with all pertinent information necessary to determine the total indebtedness owing to the City of Miami Beach on account of each parcel of land covered by said Certificates. Section 2: That Ben Shepard, Attorney at Law, be, and he is, hereby employed for the purpose of foreclosing the Tax Certificates hereinabove referred to, together with all other demands and claims held by the City, against the lands covered by said Tax Certificates, on behalf of the City of Miami Beach. Section 3: That said Attorney in return for his services in fore- * closing the Tax Certificates and ocher claims and demands above referred - to shall be paid the sum of Twenty-Five Dollars ($25.00) for the filing . V of the Bill of Complaint on behalf of the City, plus Ten per cent. (10%) of the amount found to be due in the Final Decree awarded to the City in the foreclosure proceedings. And in the event any of the Tax Certificates and/or claims and demands hereinabove re- ferred to shall be redeemed or paid, after notice of intention to file suit has been given by said Attorney and prior to the entry of a Final Decree of Foreclosure and Sale, said Attorney shall re- ceiveFiveper cent, ( 5 ) of such redemptions or collections. Section 4: That the City Manager and the City Clerk be,and they are, hereby instructed to advance from time to time to said Attorney such sums as will be necessary to pay the actual expenses of said foreclosure suit, including Court costs, title searches, advertising costs, master' s fees, and also, including any other proper expense, which in thejudgment of the City Manager is neces- sary as an indicent to said suit. Section 5: That any and all resolutions in conflict with the above and foregoing are hereby rescinded. PASSED AND ADOPTED this 1st day of August, A. D. , 1934.
