Ordinance 97-3068ORDINANCE NO. 97-3068 AN ORDINANCE OF THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING MIAMI BEACH CITY CODE CHAPTER 8, ENTITLED "BUILDING REGULATIONS" BY AMENDING SECTION 8-3 ENTITLED "SCHEDULE OF PERMIT FEES", BY AMENDING SUBSECTION (L) GENERAL INFORMATION, TO PROVIDE FOR A SANITATION IMPACT FEE; PROVIDING FOR CODIFICATION AND SEVERABILITY; REPEALING ALL ORDINANCES IN CONFLICT THEREWITH; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Miami Beach, Florida folds it in the public interest to ensure that all areas within the City limits are adequately provided with high-quality waste collection and disposal service; and WHEREAS, the City Commission finds it in the public interest to retain regulatory authority as permitted by law over waste collection and disposal because of the overriding public health, safety, welfare and ecological considerations associated with the provision of this service; and WHEREAS, the City Commission finds it in the public interest to retain control over the use of public rights of way to ensure against interference with the public convenience, to promote aesthetic considerations, and to protect the public investment in right of way property; and WHEREAS, the City Commission finds that the adding of a "Sanitation Impact Fee" to help offset the enormous costs related to the collection and disposal of illegally dumped construction related debris within the City is the best means of assuring that the above described interests of the City are served. 1 NOW, THEREFORE BE IT ORDAINED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. AMENDMENT OF CHAPTERS ENTITLED "BUMPING REGULATIONS That Section 8-3 of the Code of the City of Miami Beach is hereby amended to read as follows: SECTION 8-3. SCHEDULE OF PERMIT FEES. *** (L) GENERAL INFORMATION Following is a list of other fees collected by the Building Department for other Departments or Agencies. 1) A fee of 50.01 per Sq. Ft. of covered area will be added to Building Permits for the State of Florida to study building code requirements for Radon Gas. 2) A Surcharge of $0.50 per $1000.00 of work valuation will be added to Building Permits for the Code Compliance Program established by Dade County. 3) A Surcharge to the Building Permits will be added when processing "Marine Structures" according to schedule established by City Ordinance. 4) A Surcharge to the Building Permits will be added for the Fire Safety Process according to schedule established by City Ordinance 5) For Building Permits Walk-Thru process a surcharge will be added for Zoning Process based on schedule established by City Ordinance. 6) An Interim General and Proprietary Fee shall be charged to any building or structure for which a Certificate of Occupancy is being issued based on S0.04 per Square Foot of floor area, per month of part thereof, until the last day of December of that year. The minimum fee is $15.00 and the maximum_fee is $1.500,00. SECTION 2, CODIFICATION, It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is hereby ordained that the provisions of this ordinance shall become and be made part of the Code of the City of Miami Beach, Florida_ The sections of this ordinance may be renumbered or relettered to accomplish such intention, and the word "ordinance" may be changed to "section", "article," or other appropriate word. SECTION 3. REPEALER, All ordinances or parts in conflict herewith be and the same are hereby repealed. SECTION 4. SEVERABILITY. If any section, sentence, clause or phrase of this Ordinance is held to be invalid or unconstitutional by any court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portion of this Ordinance. SECTION 4. EFFECTIVE DATE. This Ordinance shall take effect ten (10) days after its adoption on the 18 t h day of January 19 97 . ADMINISTRATION RECOMMENDATION: The administration recommends that the city cornmission adopt an ordinance on this second reading amending Chapter 8, Section 3, Subsection (L), of the Miami Beach City Code to add a Sanitation Impact Fee; providing for severability; repealing all ordinances in conflict therewith; and providing an effective date. BACKGROUND The City Commission approved on first reading on December 18, 1996. The City of Miami Beach Sanitation Department removes an enormous amount of illegal dumping of debris by unknown person(s) in back alleys, streets, private property, and City right of ways generated from various types of new construction permits; such as building demolition, electrical, plumbing, mechanical, remodeling and rehabs of existing properties. The City's cost to collect, clean, transport and dump this debris is estimated at more than $185,000 annually. ANALYSIS To offset this cost to the City, a Sanitation Impact Fee for all Building, Electrical, Plumbing, Mechanical and Demolition Permits based upon 0.15% of the projected cost of the project for which the permit is being applied is recommended. The proposed fee structure would have a minimum fee of $15.00 and a maximum fee of $1,500.00. AGENDA ITEM l 5 C.
