A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA,
VACATING A PORTION OF AN ALLEY IM-
MEDIATELY EAST OF LOTS 9 to 12, IN-
CLUSIVE IN BLOCK 63 OF OCEAN BEACH
ADDITION NO. 3, ACCORDING TO THE
PLAT THEREOF RECORDED IN PLAT BOOK
2 AT PAGE 81, PUBLIC RECORDS OF DADE
COUNTY, FLORIDA, AND GRANTING SUCH
VACATED PORTION THEREOF TO THE OWNER
OF RECORD, HIS HEIRS OR ASSIGNS.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI
BEACH, FLORIDA:
Section 1: That that portion of the alley extending north
and south through Block 63 of Ocean Beach Addi-
tion No. 3, at present encroached upon by a wall along the
easterly line of Lots 9, 10, 11 and 12 of said Block 63 and
as shown on the attached survey sketch prepared by August
DeWinkler, Civil Engineer, a copy of which is made a part
hereof and attached hereto, be and the same is hereby vaca-
ted and the use of said vacated portion of said alley be
and the same is hereby granted to the owner of record of
the above described property on the date of the passage of
this Resolution, his heirs and assigns, subject to the
proviso hereinafter contained.
PROVIDED, HOWEVER, That if the wall now on said pre-
mises and covering the above described land is ever moved,
demolished, destroyed by fire or rebuilt, then the above
vacation of said portion of said alley and the grant of the
use of the same shall be immediately revoked, terminated and
absolutely voided without any action on the part of the City
Council of the City of Miami Beach, Florida, and said lands
above described shall again become a portion of said alley for
the public use.
