AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AMENDING CHAPTER 102,
ENTITLED"TAXATION";BY AMENDING SECTION 102-379,ENTITLED
"SCHEDULE OF TAXES," TO CREATE A NEW BUSINESS LICENSE
CATEGORY FOR VALET PARKING OPERATORS WHO CONDUCT
THEIR OPERATIONS ON PUBLIC PROPERTY; PROVIDING FOR
SEVERABILITY; CODIFICATION; REPEALER; AND AN EFFECTIVE
DATE.
WHEREAS, Section 18-336 of the Code of the City of Miami Beach provides that valet
parking operators who conduct their operations on public property shall be duly licensed by the City;
and
WHEREAS, pursuant to Section 102-379 of the City Code, valet parking operators who
conduct their operations on public property are currently licensed as parking lots, said business
license rate currently levied by the City in the amount of$220.00 per location; and
WHEREAS, in order to facilitate the financial operations of valet parking operators
conducting their business on public property, the Mayor and City Commission wish to amend
Chapter 102 of the City Code, entitled "Taxation," by amending Section 102-379 therein, entitled
"Schedule of Taxes," to create a new business category specifically for said operators; and
WHEREAS,the creation of the new business licensing category for valet parking operators
conducting their operations on public property,would essentially create a"master business license,"
for the first valet parking operation location and, thereafter, create a permit category for each
additional location, at a reduced rate; and .
WHEREAS, the proposed amendment would only impact the business license rates
currently levied against valet parking operators on public property, while maintaining all other
safeguards pertaining to the regulation of said valet parking services in the City of Miami Beach
intact, and in full force and effect.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1. AMENDMENT OF SECTION 102-379 OF THE MIAMI BEACH CITY
CODE CHAPTER 102.
Section 102-379 of Miami Beach City Code is hereby amended as follows:
Section 102-379. Schedule of Taxes.
License taxes for the following businesses, occupations or
professions are hereby levied and imposed as follows:

Valet parking operators who conduct their operations
on public property....
for the first location $220.00
for each additional location
when a permit is issued $110.00
SECTION 2. SEVERABILITY.
If any section,subsection,clause or provision of this Ordinance is held invalid,the remainder
shall not be affected by such invalidity.
SECTION 3. CODIFICATION.
It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is
hereby ordained that the provisions of this ordinance shall become and be made a part of the Code
of the City of Miami Beach,Florida. The sections of this ordinance may be renumbered or relettered
to accomplish such intention, and the word "ordinance" may be changed to "section", "article," or
other appropriate word.
SECTION 4. REPEALER.
All ordinances or parts of ordinances in conflict herewith be and the same are hereby
repealed.
SECTION 5. EFFECTIVE DATE.
This Ordinance shall take effect on the 5th day of June 1999.

ADMINISTRATIVE RECOMMENDATION:
Adopt the Ordinance.
BACKGROUND:
Miami Beach City Code Chapter 102 authorizes the City to charge parking lots a license fee of
$220.00 per location. In order to facilitate the financial operations of valet parking operators
conducting their business on public property, the fee should be amended to be $220.00 for the first
location and $110.00 for each additional location. Each location will continue to require insurance
coverage. This Ordinance was approved on first reading at the May 12, 1999 City Commission
meeting.
ANALYSIS:
Enactment of this amendment will create a "master business license" for the first valet parking
operation location and, thereafter, create "sub-license" categories for each additional location, at a
reduced rate.
CONCLUSION
The Administration recommends that the City Commission adopt the attached Ordinance.
