Ordinance 99-3185 ORDINANCE NO. 99-3185 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH,FLORIDA,AMENDING ORDINANCE NO. 789, THE CLASSIFIED EMPLOYEES' SALARY ORDINANCE, FOR THE CLASSIFICATIONS IN GROUP V, BEING THOSE CLASSIFICATIONS COVERED BY THE GOVERNMENT SUPERVISORS ASSOCIATION OF FLORIDA, IN ACCORDANCE WITH THE NEGOTIATED AGREEMENT, INCREASING THE MAXIMUM OF THE SALARY RANGE FOR EACH CLASSIFICATION BY 8% RETROACTIVELY,EFFECTIVE OCTOBER 1, 1998; RETROACTIVELY,BY 3% EFFECTIVE THE FIRST PAY PERIOD ENDING IN MAY 1999; AND BY 3% EFFECTIVE THE FIRST PAY PERIOD ENDING IN MAY 2000; INCREASING THE SALARY OF EACH EMPLOYEE BY 3% EFFECTIVE THE FIRST PAY PERIOD ENDING IN MAY 1999 AND BY 3% EFFECTIVE THE FIRST PAY PERIOD ENDING IN MAY 2000; PROVIDING FOR A REPEALER, SEVERABILITY, CODIFICATION,AND EFFECTIVE DATES. WHEREAS,by secret ballot, in an election conducted by the Public Employees Relations Commission (PERC) June 23,1998, through July 14, 1998, the employees in specific supervisory classifications, which were in the classified service of the City, but which were previously not represented by a collective bargaining unit, elected the Government Supervisors Association of Florida(GSA)to be the exclusive bargaining representative of those employees pursuant to Section 447.307 (3) (b), Florida Statutes and according to Certification number 1205 issued by PERC on July 30, 1998; WHEREAS,the City has successfully negotiated an agreement with the GSA and desires to implement the provisions of the agreement. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 4: SEVERABILITY. It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is hereby ordained that the provisions of this ordinance shall become and be made a part of the Code of the City of Miami Beach, Florida. BACKGROUND: This Ordinance was approved on first reading at the May 12, 1999, Commission meeting. The Government Supervisors Association of Florida, OPEIU Local 100, (GSA) filed a Representation-Certification Petition with the Public Employees Relations Commission(PERC) in February 1998. By secret ballot, in an election conducted by PERC, June 23,1998,through July 14, 1998,the employees in specific supervisory classifications, which were in the classified service of the City, but which were previously not represented by a collective bargaining unit, elected the Government Supervisors Association of Florida(GSA)to be the exclusive bargaining representative of those employees. Pursuant to Section 447.307(3)(b),Florida Statutes, PERC issued Certification AGENDA ITEM R5 C DATE 5-2.c0-9 Number 1205 on July 30, 1998, which certifies GSA as the exclusive bargaining representative for 42 employees currently working in 27 of our lower level supervisory job classifications. Historically, the terms and conditions of employment afforded to these employees who were previously considered as Others,and are now covered by the GSA bargaining unit,have been similar to the terms and conditions currently afforded to the CWA bargaining unit. Except as otherwise noted, the City has agreed to continue the status quo with respect to the terms and conditions of employment for this bargaining unit. - On April 15, 1999 after eight bargaining sessions,negotiators for the City and the GSA successfully concluded negotiations for a two-year collective bargaining agreement. The Association • membership has reviewed the proposed Agreement and voted to ratify it as presented.While negotiators for the City and the Association were obliged to represent the best interests of their "clients",the shared goal was to produce an Agreement that guaranteed equitable and competitive compensation and working conditions. The following is a summary of the wage issues in the Agreement. The GSA bargaining unit will get a three percent(3%) across-the-board increase effective with the first pay period ending in May 1999 and the first pay period ending in May 2000. The anticipated cost for the 1999 increase is approximately $18,700 and is already assumed in the Fiscal Year 1998/1999 budget. The anticipated cost for Fiscal Year 1999/2000 budget is $18,810. These 3%increases are identical to the pay increases scheduled for AFSCME employees and is in keeping with the across-the-board increases that the Administration will propose for its non-union employees in Fiscal Years 1998/1999 and Fiscal Year 1999/2000. The Agreement will extend for a two-year term,thus ending the same time as the CWA, FOP, and IAFF agreements expire, i.e., September 30, 2000. CONCLUSION: The Administration recommends that the Mayor and City Commission adopt the Ordinance,in order to implement the salary range amendments included in the collective bargaining agreement negotiated between the City of Miami Beach and GSA.
