SUBJECT: Indian Creek Drive Seawall Repl cement Corrective Action
The purpose of this Letter to Commission is to notify you of non-compliance associated with the
seawall replacement along Indian Creek Drive and the corrective actions that the city is taking to
bring the project fully into compliance.
On December 18, 2017, representatives from the City of Miami Beach, Miami -Dade County, the
South Florida Water Management District, the U.S. Army Corps of Engineers, and Shoreline
Foundation Inc. participated in an interagency field meeting to review the Indian Creek Drive
Seawall Replacement project. At the meeting, the representatives walked the work area, reviewed
the activities, and identified activities that require corrective action including:
1. Sections of the seawall have been completed prior to receiving verification from the U.S.
Army Corps of Engineers.
2. Sections of the seawall were installed beyond the allowed maximum distance from the wet
face of the seawall.
3. Spoil piles were staged adjacent to the Indian Creek waterway not consistent with
sediment and erosion control Best Management Practices.
I am troubled by these findings and the lack of adherence to environmental policies and
regulations. I am therefore closely studying the operations and practices in the engineering
division, as well as the contractual responsibilities of our environmental consultant, Stantec, and
construction contractor, Shoreline Foundation. I expect to make changes to ensure that this does
not occur again in other projects and that all parties are held responsible. The city has already
taken the following corrective actions:
1. Immediately following the meeting, the city put the contractor (Shoreline Foundation Inc.)
on notice of these matters and directed them to stop all work on the project.
2. The city also directed Shoreline Foundation Inc. to immediately remove the spoil piles from
the shoreline, which were removed within 48 hours.
I am committed to bringing this project fully into compliance as quickly as possible and my team
will be meeting again with the contractor and the regulatory agencies in the coming weeks to
agree on an appropriate plan of action. Rest assured that my administration is committed to
investing in replacing aging infrastructure and adapting to climate change while also complying
with all environmental regulations that protect the beauty and value of our natural systems.
