AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA,AMENDING ARTICLE
VI, OF CHAPTER 82 OF THE MIAMI BEACH CITY CODE,
ENTITLED "NAMING OF PUBLIC FACILITIES AND STREETS
AND ESTABLISHMENTS OF MONUMENTS OR MEMORIALS",
CREATING SECTION 82-505 PROVIDING FOR THE
ACCEPTANCE OF MONETARY DONATIONS IN
CONSIDERATION FOR THE NAMING OF PUBLIC FACILITIES;
PROVIDING FOR CODIFICATION,REPEALER, SEVERABILITY,
AND AN EFFECTIVE DATE.
WHEREAS,on February 3, 1999,the Mayor and City Commission referred an item to the
Community Affairs Committee for review and discussion regarding naming public facilities after
individuals or corporations in consideration for monetary donations; and
WHEREAS,at its February 24, 1999 meeting,the Community Affairs Committee discussed
the issue and voted to establish criteria for donations based on the current Naming Ordinance; and
WHEREAS, currently, the City Code provides guidelines for naming public facilities in
honor of an individual when no donation is involved; however, the City Code does not contain
language regarding naming in consideration for monetary donations.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH,FLORIDA:
ARTICLE VII. NAMING OF PUBLIC FACILITIES AND STREETS AND
ESTABLISHMENTS OF MONUMENTS OR MEMORIALS
SECTION 1. CREATION OF SECTION 82-505 OF CITY CODE CHAPTER 82
That Section 82-505 of the Miami Beach City Code is created as follows:
Sec. 82-505. Acceptance of monetary donations in consideration for the naming of
public facilities.
a) Review and Recommendation Committee.
Whenever there is a proposal to rename an existing public facility or interior portion of a public
facility or plaza within or owned by the City in consideration for monetary donations,the naming.,
or renaming, shall first be considered and reviewed by the Community Affairs Committee
(Committee) according to the following procedures:

(1) Any person, organization, association, corporation or other entity, may offer a
monetary donation in consideration for renaming an existing public facility or
interior portion of a public facility or plaza at any time, by submitting a proposal to
the Committee.
a) Within a reasonable time after receipt of the proposal. the Committee shall meet to
consider and review proposals. Notice of the meeting shall be given to all persons
who have submitted proposals.
(3) After reviewing the proposal in accordance with its established selection criteria,the
Committee shall transmit a written recommendation to the City Commission
regarding the proposal.
4) Notwithstanding any other provision of this Section. public facilities or interior
portions of public facilities or plazas shall not be named after a living individual
unless the individual is over 100 years old. A public facility or interior portion of
a public facility or plaza can be named in honor of a family.
al A public facility or interior portion of a public facility or plaza will not be named
after an individual who has committed an illegal act which became known to the City
before or after the donation.
b) Public hearing; selection of name by City Commission; referendum; sunsetting of
name designation.
Ll) Within a reasonable time after receiving the proposal from the Committee, the City
Commission shall call a public hearing.
(2) Notice of a public hearing regarding the proposal shall be published at least ten(10)
days prior to the hearing in a newspaper of general circulation in the city.
(3) Where a public facility other than the interior portion of a public facility or a plaza
is to be named,the City Commission may only consider a name approved by a two-
thirds vote of the Committee and a five-sevenths vote of the City Commission: the
naming of the interior portion of a public facility or plaza shall require a simple
majority vote of both.
(44) Referendum requirements shall not apply to this Section 82-505.
(5) Sunsetting provisions shall not apply to this Section 82-505.

SECTION 3. SEVERABILITY.
If any section, subsection, clause or provision of this Ordinance is held invalid, the remainder shall
not be affected by such invalidity.
SECTION 4. CODIFICATION.
It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is hereby
ordained that the provisions of this Ordinance shall become and be made a part of the Code of the
City of Miami Beach, Florida. The sections of this Ordinance may be renumbered or relettered to
accomplish such intention,and the word"Ordinance"may be changed to "section", "article",or other
appropriate word.
SECTION 5. REPEALER.
That all Ordinances or parts of Ordinances in conflict herewith be and the same are hereby repealed.
.SECTION 6. EFFECTIVE DATE.
This Ordinance shall take effect on the 3rd day of July , 1999.

ADMINISTRATION RECOMMENDATION
Adopt the Ordinance.
BACKGROUND
On February 3, 1999,the City Commission referred an item to the Community Affairs Committee
for review and discussion regarding naming facilities after individuals or corporations in return for
monetary donations.
At its February 24, 1999 meeting, the Community Affairs Committee discussed the issue. The
Committee agreed that although the referral indicated that the policy be proposed for fundraising for
the North Beach Youth Center, the donation policy should apply to all publicly-owned property.
The Committee reviewed a report prepared by the Administration regarding the donation policies
of other organizations and discussed basic parameters and criteria for accepting donations. The
Committee agreed that the policy for accepting donations in consideration for naming facilities
should follow a procedure similar to the current policy in the City Code on naming public facilities
and streets.
Currently,the City Code provides guidelines for naming public facilities in honor of an individual
when no donation is involved. However, the Code does not contain language regarding naming in
consideration for donations. Local organizations, such as Mount Sinai Medical Center Foundation

base their naming policy on monetary donations, with the amount of each donation corresponding
to a specific item. The Foundation has a complete list of all open spaces, nursing homes, buildings,
interior portions of buildings and streets (private). Each item has a dollar value associated to it in
recognition of a certain level of giving. The minimum starting level for naming is $200,000.
Similarly, the Bass Museum has set up a named gift opportunities program to support the Bass
Expansion and Renovation Project. In consideration for monetary gifts and donations,the donor will
have his/her name prominently featured on or near the designated named facility as well as on a
Major Wall located in the Museum entrance. A minimum contribution of$50,000 is required, (see
Exhibit 1).
After discussions with staff of the City Attorney's Office, as well as the Administration and
consulting with other local municipalities,the following Ordinance has been drafted, and is before
the City Commission today,as directed by the Community Affairs Committee. The Ordinance was
approved on first reading on June 9, 1999.
ANALYSIS
The proposed Ordinance amends Chapter 82,Article VI of the City Code by creating Section 82-505
entitled "Naming of Public Facilities in Consideration for Monetary Donations." Section 82-505 of
the Miami Beach City Code is created as follows:
a) Review and Recommendation Committee

(4) Notwithstanding any other provision of this section, public facilities shall not be
named after a living individual unless the individual is over 100 years old. A public
facility can be named in honor of a family.
(5) A public facility will not be named after an individual who has committed an illegal
act which became known to the City before or after the donation.

CONCLUSION
It is recommended that the City Commission approve the amendment to the Ordinance on second
and final reading. Approval of the Ordinance is recommended by the Community Affairs
Committee in order to create provisions for the acceptance of monetary donations in consideration
for the naming of public facilities.
