A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA, VACAT-
ING A PORTION OF THE INTERSECTION OF
LINCOLN ROAD AND MICHIGAN AVENUE ADJOIN-
ING LOT 6, BLOCK 38, COMMERCIAL SUBDI-
VISION ACCORDING TO A"PLAT THEREOF RE-
CORDED IN PLAT BOOK 6, PAGE 5 OF THE
PUBLIC RECORDS OF DADE COUNTY, FLORIDA,
AND GRANTD'!G SUCH VACATED PORTION THEREOF
TO THE OWNERS OF RECORD, THEIR HEIRS AND
ASSIGNS.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
Section 1: That that portion of the intersection of Lincoln
Road and Michigan Avenue adjoining Lots 6, Block
38, Commercial Subdivision according to the
plat thereof recorded in Plat Book 6, Page 5, of the Public
Records of Dade County, Florida, at present encroached upon
by the Community Theatre Building, as shown on the 'attached
survey sketch prepared by Zurwelle-dhittaker, Inc. , Engineers,
a copy of which is made a part hereof and attached hereto
be and the same is hereby vacated and the use of said vacated
land be and the same is hereby granted to the owners of record
of the above deScribed property on the date of the passage of
this Resolution, their heirs and assigns, subject to the proviso
hereinafter contained.
PROVIDED, HUIEVER, that if the Community Theatre Building
now on said nremises and covering the above described. land is
ever moved, demolished, destroyed r fire or rebuilt, then the
above vacation of said portion of the intersection of Lincoln
Road and Michigan Avenue, and" the Grant of the use of the same
shall be immediately revoked, terminated and absolutely voided
without any action on the nart of the City Council of the City
of Miami Beach, Florida, and said land above described shall
again become a portion of said Lincoln Road and Michigan Avenue
for the public use.
