Ordinance 99-3198 ORDINANCE NO, 99-3198 • AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH,FLORIDA,AMENDING CHAPTER 86 OF THE MIAMI BEACH CITY CODE, ENTITLED "SALES," BY AMENDING ARTICLE H ENTITLED "GARAGE SALES," BY AMENDING SECTION 86-56(F), TO MODIFY THE REQUIREMENTS FOR GARAGE SALE PERMIT REQUESTS TO PROVIDE FOR IMMEDIATE APPROVAL OR DENIAL OF SAID REQUESTS; PROVIDING FOR REPEALER, SEVERABILITY, CODIFICATION, AND AN EFFECTIVE DATE. WHEREAS the City of Miami Beach Licensing Section wishes to make the process of obtaining a Garage Sale Permit more "user friendly" to the Citizens of Miami Beach. NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. That Subsection 86-56(f) of Miami Beach City Code Chapter 86, entitled "Required" is hereby amended as follows: (f) All garage sale permit requests must be made no later than 3 P.M. of the day prior to the requested at least seven days prior to the date of the sale. Responses to the requests (i.e., permit approval or permit denial) will be issued mailed to the applicant immediately upon review of the application prior to the date of sale. SECTION 2. REPEALER All ordinance or parts of ordinance in conflict herewith be and the same are hereby repealed. SECTION 3. SEVERABILITY If any section, subsection, clause or provision of this Ordinance is held invalid, the remainder shall not be affected by such invalidity. SECTION 4. CODIFICATION It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is hereby ordained the provisions of this Ordinance shall become and be made part of the Code of the City of Miami Beach, Florida. The sections of this Ordinance may be renumbered or relettered to accomplish such intentions, and the word "ordinance" may be changed to "section", "article", or other appropriate word. SECTION 8. EFFECTIVE DATE This Ordinance shall take effect on the 30thday of July , 1999. PASSED AND ADOPTED this 20th day of July , 1999. ADMINISTRATION RECOMMENDATION: Adopt the Ordinance. BACKGROUND: The City of Miami Beach Licensing Section issues approximately 200 Garage Sale Permits each year. Many times applications have to be denied due to the fact that the current code requires that applications be made at least seven days in advance and that the permit be mailed to the applicant. The Ordinance was approved on first reading by the City Commission on July 7, 1999. ANALYSIS: Automation and streamlining of various procedures now enable applications to be reviewed and processed in a more expeditious manner. The Licensing Section has the capacity to process the application during normal business hours Monday through Friday,and notify the proper departments as late as 3 P.M. of the day prior to the date of the sale. The applicant can be issued the permit immediately after the application is reviewed and processed. In the interest of becoming more "user friendly" to the citizens of Miami Beach we recommend that applications can be made anytime up to 3 P.M. of the day prior to the sale date. Furthermore, the permit can be issued right on the spot rather than mailing it to the applicant.
