A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA, VACAT-
ING A PORTION OF OCEAN DRIVE IMMEDIATELY
WEST OF AND A PORTION OF FOURTH STREET
IMMEDIATELY SOUTH OF LOTS 7 , 8 AND 9
BLOCK 116, OCEAN BEACH ADDITION NO. 4+,
ACCORDING TO THE PLAT THEREOF RECORDED
IN PLAT BOOK 3 AT PAGE 151 OF THE PUBLIC
RECORDS OF DADE COUNTY, FLORIDA, AND GRANT-
ING SUCH VACATED PORTION THEREOF TO THE
OWNERS OF RECORD , THEIR HEIRS AND ASSIGNS.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
Section 1: That that portion of Ocean Drive immediately West
of loots 7, 8 and 9, Block 116 of Ocean Beach Addition
No. 4, according to the plat thereof recorded in
Plat Book 3 at Page 151 of the Public Records of Dade County,
Florida, at present encroached upon by an over-hanging balcony,
wall and coping along the West line of said lots , as shown on
the attached survey sketch prepared by Biscayne Engineering
Company, J. J. Bennett, Registered Engineer, a copy of which
is made a part hereof and attached hereto , and that portion of
Fourth Street immeliately South of said lots, at present en-
croached upon by steps and/or coping along the South line of
Lot 9, as shown on said survey sketch, be and the same are hereby
vacated, and the use of said vacated portions of said Ocean Drive
and Fourth Street be , and the same are hereby granted to the
owners of record of the above described property on the date of
the passage of this Resolution, their heirs and assigns, subject
to the proviso hereinafter contained.
PROVIDED, HOWEVER, that if the over-hanging balcony, wall ,
coping and/or steps now on said premises and covering the above
described land are ever moved, demolished, destroyed by fire or
rebuilt, then the above vacation of said portions of Ocean. Drive
and Fourth Street and the grant of the use of the same shall be
immediately revoked, terminated and absolutely voided, without
any action on the part of the City Council of the City of Miami
Beach, Florida, and said lands above described shall again be-
come a portion of said Ocean Drive and Fourth Street for the
public use.
