Resolution 3352 RESOLUTION NO. 3352
WHEREAS, it has been represented to the City Council
of the City of neat Beach that aocording to a recent survey
made by !41. B. Ciarris under date of f,etember 18th, 1935,
on and in coanection with Block 3-B of First Addition to
Whitman' s Subdivision of I:pnanola Villas, in the City of
Miami Beach, Dade County, Florida, as per plat recorded in
Plat Book 9, Page 147 of the Public Records of Dade County,
Florida, that there exist certain encroachments of the build-
ins now erected on the said property on washington Avenue,
Espanola ,ay and Drexel Avenue , and
4HEREAS, it has been represented to the said City Council
that in oonnection with a proposed first mortgage loan on said
property expected to be laced with Connecticut General Life
Insurance Company, a corporation of Connecticut, that these
encroachments ere interfering with the proourealene of said
loan and request has been made to said City Council by persons
interested in the property and the procurement of a loan for
a waiver and agreement against disturbance of the property by
reason of said encroachment.
NO5 , THEREFORE, BE IT RESOLVED BY THE CITY COUVCIL OF THE
CITY OF MIAMI BEACH , FLORIDA, that no disturbance, claims or
actiorm will be made or taken by the City of had Beach, Flori-
da, during the term of the proposed loan to said Connecticlzt
General Life Insurance Company, or any extension thereof and
that no disturbance or action will be made or taken by the City
of NUM Beach, Florida, in connection with the said encroach-
ments during the existence of the building or buildings as now
erected upon the property above described.
