Resolution 3382 RESOLUTION NO. 3382
WHEREAS, it has been represented to the City Council of
the City of Miami Beach that according to a recent survey made
by M. B. Garis under date of December 7, 1935, on and in connection
with Lots Ten (10) , Eleven (11) and Twelve (12) in Block Forty-
Eight (48) of Lincoln Subdivision, according to the plat thereof
recorded in Plat Book 9 at Page 69 of the Public Records of Dade
County, Florida, that there exist certain encroachments of the
buildings now erected on the said property on Michigan Avenue and
Lincoln Road, and
WHEREAS, it has been represented to the said City Council
that in connection with a proposed first mortgage loan on said
property expected to be placed with Connecticut General Life
Insurance Company, a corporation of Connecticut, that there en-
croachments are interfering with the procurement of said loan,
and request has been made to said City Council by persons interested
in the property and the procurement of a loan for a waiver and
agreement against disturbance of the property by reason of said
encroachment,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA, that no disturbance, claims or
actions will be made or taken by the City of Miami Beach, Florida,
during the term of the proposed loan to said Connecticut General
Life Insurance Company, or any extension thereof and that no dis-
turbance or action will be made or taken by the City of Miami
Beach, Florida, in connection with the said encroachments during
the existence of the building or buildings as now erected upon
the property above described.
