Ordinance 98-3111ORDINANCE NO. 98-3111 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING A NEW CHAPTER ENTITLED "AGENCIES, BOARDS, AND COMMITTEES" BY CREATING SECTION 2.1.1 THEREOF ESTABLISHING THE BEACH PRESERVATION COMMITTEE; PROVIDING FOR CODIFICATION, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the Mayor and City Commission of the City of Miami Beach wish to create a Beach Preservation Committee which will have the authority to carry out various purposes relating to the preservation, maintenance and safety of the City's beaches. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. That Part II of the Miami Beach City Code chapter entitled "Agencies, Board, and Committees", be amended as follows: CHAPTER: AGENCIES, BOARDS AND COMMITTEES Table of Contents I. GENERAL PROVISIONS II. AGENCIES, BOARDS AND COMMITTEES The following portion of this Chapter sets forth the City of Miami Beach's agencies, boards and committees, including their respective purposes, powers and duties, composition, City affiliation requirements, attendance and terms. * * * Sec. 2.1.1 BEACH PRESERVATION COMMITTEE Sec. 2.1.1 There is hereby established the Beach Preservation Committee whose purposes, power and duties, composition, membership qualifications, and general governing regulations are as follows. Sec. 2.1.1.2 PURPOSE: The Beach Preservation Committee aids the Commission in its desire to maintain, preserve, and protect the beaches and boardwalk of the City of Miami Beach and to promote and maintain a clean, safe, and ecologically sound environment to be enjoyed by its citizens and visitors. Sec. 2.1.1.3 POWERS AND DUTIES: The Beach Preservation Committee is vested with the power and authority to make recommendations to the City Commission of Miami Beach upon the following matters: 2 a) The investigation, development, and carrying out of plans for the preservation and renourishment of the beaches in the City of Miami Beach, including, but not limited to, erosion control. • To foster and maintain a clean, safe, and litter free beach environment by exploring the availability of enforcement techniques, programs, or new legislation to accomplish these goals. • The encouragement of a desire in the citizenry of the City of Miami Beach to maintain and preserve the City's beaches. • The recommendation of plans to the City Commission, as well as to other local, state, and federal governmental agencies, for the preservation and renourishment of the City's beaches. Sec. 2.1.1.4 COMPOSITION: The Committee shall consist of seven (7) voting members, one appointed by the Mayor and each Commissioner, and three (3) non-voting ex -officio members to be comprised as follows: Seven (7) citizens having an interest in the preservation of the City's beaches and the purposes of the Committee. The City's Environmental Specialist as an ex -officio member. An individual appointed by the Miami Dade County Department of Environmental Resources Management (DERM). Natural Resources Division who holds the position of Special Projects Administrator II as an ex -officio member. A member of the City's Beach Patrol, who shall receive the highest number of votes in an election by persons holding the positions of Lifeguard I, Lifeguard II, and Lieutenant, as an ex -officio member. The Chairperson of the Committee or his/her designee shall serve as a non-voting ex -officio member of the Recreational Centers and Parks Facilities Board (to be renamed the "Parks and Recreational Facilities Board"). Sec. 2.1.1.5 KNOWLEDGE AND EXPERIENCE: See "Composition." SUPPORTING DEPARTMENT: Recreation, Culture and Parks. * * * 3 SECTION 2. CODIFICATION. It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is hereby ordained that the provisions of this ordinance shall become and be made a part of the Code of the City of Miami Beach, Florida. The sections of this ordinance may be renumbered or relettered to accomplish such intention, and the word "ordinance" may be changed to "section", "article," or other appropriate word. SECTION 3. SEVERABILITY. If any section, sentence, clause or phrase of this ordinance is held to be invalid or unconstitutional by any court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this ordinance. SECTION 4. REPEALER. All resolutions, ordinances, or other City legislation in conflict herewith be and the same are hereby repealed. SECTION 5. EFFECTIVE DATE. This Ordinance shall take effect on the 31st day of January, 1998.
