A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, CALLING A PUBLIC HEARING TO
CONSIDER AN APPLICATION BY FLAMINGO HOTEL PARTNERS, AS
THE OWNER OF THE FLAMINGO HOTEL, LOCATED AT 5875 COLLINS
AVENUE, MIAMI BEACH, FLORIDA, FOR THE VACATION OF THAT
PORTION OF COLLINS AVENUE FRONTING THE FLAMINGO HOTEL,
WHICH WAS CREATED AS A RESULT OF THE RE-ALIGNMENT OF
COLLINS AVENUE IN 1964.
WHEREAS, Flamingo Hotel Partners, is the owner of the Flamingo Hotel, located at 5875
Collins Avenue, Miami Beach, Florida (the Property); and
WHEREAS, Flamingo Hotel Partners is in the process of selling the Property; and
WHEREAS, Collins Avenue has been a State of Florida Roadway since 1964, when it w, s
transferred from the City to the State of Florida; and
WHEREAS, in 1964 (prior to becoming a State Road,) a portion of Collins Avenue wa:; n -
aligned, said re-alignment affecting the Property whereby a portion of the Property today sits 'In a
triangular shaped portion of property which was once Collins Avenue; and
WHEREAS, pursuant to the sale of the Flamingo Hotel, a search for documents whie 1
affected the re-alignment, either in the Florida Department of Transportation and/or the City, he S
been unsuccessful; and
WHEREAS, in light of the foregoing, there is nor record and/or recorded documentatio 1
indicating any exchange of deeds as a result of said re-alignment; and
WHEREAS, in order to clear a prospective cloud on title, Flamingo Hotel Partners he ')
requested that the City vacate that said portion of Collins Avenue fronting the Flamingo Hote ,
which was created as a result of the re-alignment of Collins Avenue in 1964; and
WHEREAS, pursuant to the City's guidelines/criteria for considering right-of-way an 1
easement vacation requests, as established by the Mayor and City Commission, following a rev ie' v'
by the Land use Committee, on July 26, 1989, the Mayor and City Commission require that a publi,:;
hearing be held to consider the aforestated request.

NOW THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that a public hearing t)
consider a request by Flamingo Hotel Partners, as the owner of the Flamingo Hotel, located at 587)
Collins Avenue, Miami Beach, Florida, for the vacation of that portion of Collins A venue frontin s
the Flamingo Hotel, which was created as a result of the re-alignment of Collins Avenue in 196. ,
is hereby called to be held before the Mayor and City Commission in the Commission Chamber:.,
1700 Convention Center Drive, Third Floor, Miami Beach, Florida, on May 21, 1997, beginning (t
2: 45 pm, and the City Clerk is hereby authorized and directed to publish appropriate public notice ( f
said public hearing in a newspaper of Miami Beach, at which time and place all interested paJtif S
