AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AMENDING PART II: GOALS,
OBJECTIVES AND POLICIES OF THE CITY OF MIAMI BEACH
COMPREHENSIVE PLAN,BY ADDING POLICIES AND OBJECTIVES TO
THE CONSERVATION/COASTAL ZONE AND RECREATION AND OPEN
SPACE ELEMENTS ADDRESSING ENVIRONMENTAL PROTECTION,
LAND ACQUISITION,GREENWAYS AND RECREATIONAL FACILITIES;
AND, DIRECTING TRANSMITTALS OF THIS ORDINANCE AND ALL
APPLICABLE DOCUMENTS TO AFFECTED AGENCIES; PROVIDING
FOR REPEALER, SEVERABILITY, INCLUSION IN THE
COMPREHENSIVE PLAN AND AN EFFECTIVE DATE.
WHEREAS,the environment and natural resources are the foundation of the City of Miami
Beach's economic and social well-being and the basis of the City's unique, urban quality of life.
WHEREAS, Part II: Goals, Objectives and Policies of the City of Miami Beach the
Comprehensive Plan should include the City's current environmental directives and quality of life
initiatives.
WHEREAS, the Atlantic Greenway Corridor Initiative represents a major City wide
objective to develop greenways,to acquire land for urban greenspace,to expand outdoor recreational
opportunities,to protect natural areas,and to promote sustainable economic growth and thus should
be included in the Comprehensive Plan.
WHEREAS, inclusion in the Comprehensive Plan is also an eligibility requirement for
certain funding and technical assistance opportunities from the State of Florida.
WHEREAS,the Atlantic Greenway Corridor Initiative contains projects for which funding
and technical assistance will be sought from State of Florida programs that require local government
projects to be included in their Comprehensive Plan.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1. The Commission hereby approves amendments to the Conservation/Coastal
Zone Element of Part II: Goals, Objectives and Policies of the City of Miami Beach Comprehensive
Plan, as amended, as follows:
Policy 2.2
All development activities that adversely affect habitat that may be critical to endangered,threatened,
or rare species, or species of special concern, including native vegetative communities, shall be
prohibited by the City through the development review process (Sections 17 and 18 of the Land
Development Regulations).

Policy 2.23

The City shall continue the policy of ensuring the protection of natural areas and open space through
public acquisition of land.
SECTION 2. The Commission hereby approves amendments to the Recreation and Open
Space Element Part II: Goals, Objectives and Policies of the City of Miami Beach Comprehensive
Plan, as amended, as follows:

Policy 3.6
The City of Miami Beach shall continue to apply for State and Federal grant funds, such as the
Florida Recreation Development Assistance Program,the Land and Water Conservation Fund,and
the Coastal Management Grant Program, and Florida Communities Trust program, for the
improvement of public recreation and open space, including but not limited to nature trails or
boardwalks, greenways, waterway trails, interpretive displays, educational programs, wildlife
observation areas, or picnic areas.

Policy 4.5
To ensure environmental sustainability,protection of natural areas and quality of urban life by the
public acquisition of land for use as publicly accessible urban greenspace and scenic open space
vistas.

OBJECTIVE 5: NETWORK OF GREENWAYS AND CORRIDORS
To develop a network of greenways, scenic open space vistas,beachfront promenades, bicycle and
pedestrian trails, and multi-purpose public access corridors to waterways, the beach and outdoor
recreational opportunities, in order to preserve natural ecosystems and to enhance the quality of
urban life.
Policy 5.1
To implement the Atlantic Greenway Corridor Initiative which includes, but is not limited to,
implementing the following projects: The Indian Creek Greenway Corridor, North Beach
Recreational Corridor, Bath Club Historic Site Corridor and Scenic Vista, Beach Walk Corridor,
Dade Boulevard Corridor, Collins Canal Reconstruction, 23rd Street Bridge Reconstruction,
Venetian Way Corridor,Lummus Park Corridor, South Beach Corridor, South Pointe Park Corridor,
and Bay Walk Corridor.
Policy 5.2
To acquire and display interpretive signage throughout the City's greenways to provide historical,
cultural and environmental information about the area to the general public.

SECTION 3. REPEALER.

That all Ordinances or parts of Ordinances in conflict herewith be and the same are hereby
repealed.
SECTION 4. SEVERABILITY.
If any section, subsection,clause or provision of this Ordinance is held invalid,the remainder
shall not be affected by such invalidity.
SECTION 5. INCLUSION IN COMPREHENSIVE PLAN.
It is the intention of the City Commission, and it is hereby ordained that Sections 1 and 2 are
made part of the City of Miami Beach Comprehensive Plan, as amended; that the sections of this
Ordinance may be renumbered or relettered to accomplish such intention; and that the word
"ordinance" may be changed to "section" or other appropriate word.
SECTION 6. EFFECTIVE DATE.
This Ordinance shall take effect on the 22nd day of July ,2000,however,the
effective date of any plan amendment shall be in accordance with Section 163.3184, Florida
Statutes.

SUBJECT: Comprehensive Plan Text Amendment-Environmental Protection/Greenways
An Ordinance of the Mayor and City Commission of the City of Miami Beach,
Florida,Amending Part II: Goals, Objectives and Policies of the City of Miami
Beach Comprehensive Plan, by Adding Policies and Objectives to the
Conservation/Coastal Zone and Recreation and Open Space Elements
Addressing Environmental Protection, Land Acquisition, Greenways and
Recreational Facilities; And,Directing Transmittals of this Ordinance and All
Applicable Documents to Affected Agencies; Providing for Repealer,
Severability, Inclusion in the Comprehensive Plan and an Effective Date.
ADMINISTRATION RECOMMENDATION
The Administration recommends that the City Commission, upon second reading public hearing,
adopt the proposed Comprehensive Plan text amendment.
ANALYSIS
An amendment to the Comprehensive Plan regarding policies for environmental protection, land
acquisition, greenways and recreation facilities was referred to the Planning Board by the City
Commission at its February 9, 2000 meeting.
The City of Miami Beach's Comprehensive Plan, represented by Part II: Goals, Objectives,
Policies, does not currently include objectives or policies regarding greenways. Because the City
considers developing greenway projects,such as the Indian Creek Greenway, including information
on greenways in the Comprehensive Plan will maintain consistency between the City's published
goals and current initiatives.
Additionally, funding opportunities from the State and Federal governments often require that
applicant projects are listed in a published,publicly available long range plan. For example,both
the Florida Communities Trust and the Governor's Fast Track initiative require that an applicant's
project, as well as goals implicitly supporting the project, be stated in the applicant's
Comprehensive Plan.

The attached amendments address issues that will increase the City's performance on these type
of grant applicants. Each new or revised objective or policy is explained below:
CONSERVATION/COASTAL ZONE ELEMENT
Policy 2.2
Adds language that protects native plants, which is a major conservation issue at the State Level.
Policy 2.23
Supports the public acquisition of land as a form of protection for open spaces and,thus, coastal
management, allowing for grant applications under this premise.
RECREATION AND OPEN SPACE ELEMENTS
Policy 3.6
Adds the Florida Communities Trust to a list of possible funding opportunities and also enumerates
possible projects such as greenways.
Policy 4.5
States that the public acquisition of open space supports sustainability and the quality of urban life,
a U.S. Environmental Protection Agency directive, and the basis of possible future funding.
OBJECTIVE 5: GREENWAYS
Adds the concept of a greenway and like projects such as beach walks.
Policy 5.1
Lists all projects in the Atlantic Corridor Network to make them eligible for funding opportunities
that require Comprehensive Plan inclusion.
Policy 5.2
Adds an educational and historical element to the greenway concept to provide for future signage
needs and funding opportunities.
At its February 29, 2000 meeting, the Planning Board voted 7-0 to recommend approval of the
proposed Comprehensive Plan text amendment. On March 15, 2000, the City Commission
approved the proposed amendment on first reading. The June 14, 2000 Objections,
Recommendations and Comments (ORC) Report from the Florida Department of Community
Affairs(DCA)makes some suggestions for minor revisions which have been incorporated into the
ordinance, and are detailed in Attachment"A", Response to ORC Report.

Based on the foregoing analysis,the Administration recommends that the Commission adopt,upon
second reading public hearing,the proposed amending Ordinance to Part II: Goals, Objectives,and
Policies of the City of Miami Beach Comprehensive Plan, as it would add policies and objectives
to the Conservation/Coastal Zone and Recreation and Open Space Elements addressing
environmental protection, land acquisition, greenways and recreational facilities.

Response to ORC Report
Conservation/Coastal Zone Element
In response to the Department's comment #1, the title of Objective 5 has been changed from
"GREENWAYS"TO "NETWORK OF GREENWAYS AND CORRIDORS",to more accurately
reflect the contents of the objective.
In response to the Department's comment#2, the language in Policy 5.1 has been changed from
"To promote the Atlantic Greenway Corridor Initiative which includes, but is not limited to,
implementing the following projects...." to "To implement the Atlantic Greenway Corridor
Initiative which includes,but is not limited to, implementing the following projects...." in order to
be more action oriented and to describe what will be accomplished.
