Resolution 3496 RESOLUTION NO. 3496
WHEREAS, the City of Miami Beach Water Department, at the
expense of The Sunset Islands Company, is about to install certain
permanent water mains on Islands numbered 1, 2 and 3 of Sunset
Islands as per 2nd revised Plat, recorded in Plat Book 34, Page
73, of the Public Records of Dade County, Florida, and
WHEREAS, there will be used on Island No. 3 approximately
3800 feet of eight inch castiron pipe now on the ground and the
property of The Sunset Islands Company, and
' HEREAS, The Sunset Islands Company is to furnish to the
City of Miami Beach Water Department the sum of $9, 885.67 with
which the said water department is to purchase material, and
WHEREAS, The Sunset Islands Company is to meet the costs
of labor and miscellaneous expense as the same accrue and is to
furnish approximately 3800 feet of eight inch castiron pipe now
on the ground on Island No. 3 as aforesaid;
NOW, TH REFORE, BE IT RESOLVED by the City Council of the
City of Miami Beach, Florida, that said City refund to the said
The Sunset Islands Company, the said costs of installation
including material and labor in two ( 2) equal annual installments,
the first of which installment shall be paid one year from the
time the ordinary annual revenue from said installation derived
from ordinary household use equals at least fifteen percent
of the total cost thereof, including material and labor, and the
value of the eight inch castiron pipe now on the ground of Island
No. 3 shall be fixed for the purpose of such reimbursement at an
amount equal to the actual saving accomplished by using said eight
inch castiron pipe instead of purchasing new six inch pipe, said
value to be determined by the City Manager and. Superintendent of
the Water Department of the City of Miami Beach.
BE IT FURTHER RESOLVED that this resolution shall not be
deemed to authorize the actual payment to The Sunset Islands
Company of the refund herein referred to, but such authority shall
be included in a Resolution of this Counci4 when the installation
of said permanent water mains shall have been completed and
said Resolution shall set forth the exact amount of such refund
