Ordinance 98-3119 Agenda Item R5F 2a ORDINANCE NO. 98-3119 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AMENDMENTS TO THE "SOUTH SHORE REVITALIZATION STRATEGY," AN APPROVED REDEVELOPMENT PLAN UNDER THE PROVISIONS OF SECTIONS 163.360 AND 163.361, FLORIDA STATUTES, BY PROVIDING THAT THE SOUTH SHORE REVITALIZATION STRATEGY SHALL CONTROL EXCEPT WHEN PROPERTIES ARE GOVERNED BY THE SSDI DEVELOPMENT AGREEMENT DATED APRIL 17, 1986, AS AMENDED OR SUPPLEMENTED FROM TIME TO TIME,OR A VALIDLY EXISTING DEVELOPMENT OF REGIONAL IMPACT DEVELOPMENT ORDER ("DO"), IN WHICH CASE THE PROVISIONS OF THE SSDI DEVELOPMENT AGREEMENT OR DO SHALL CONTROL FOR TERMS, PROVISIONS, MATTERS OR ISSUES SPECIFICALLY ADDRESSED IN SUCH AGREEMENT OR DO AND MODIFICATIONS TO THE PARKING PROVISIONS;PROVIDING FOR SEVERABILITY;AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the City of Miami Beach, Florida(the "City") on February 15, 1984 adopted the South Shore Revitalization Strategy Plan, a redevelopment plan under the provisions of Section 163.360, Florida Statutes; and WHEREAS,the City is authorized pursuant to Section 163.361 to amend as necessary its adopted redevelopment plan; and WHEREAS, the City entered into a Development Agreement dated April 17, 1986 (hereinafter the"SSDI Development Agreement"), with the Miami Beach Redevelopment Agency and the South Shore Developers, Inc. in order to resolve certain controversies and litigation involving certain property within the City, and the South Pointe Redevelopment Area; and WHEREAS, the Portofino Entities has submitted an application for approval of a Development of Regional Impact ("DRI") which encompasses several parcels within the South Pointe area: and WHEREAS,the Portofino Entities are the successors in interest to South Shore Developers, Inc; and WHEREAS, the proposed amendments to the South Shore Revitalization Strategy are in furtherance of the terms of the SSDI Development Agreement and the DRI; and Agenda Item R5F 2a WHEREAS,the Miami Beach Planning Board has held the required public hearing on the proposed amendments on December 1, 1997, giving due public notice thereof, and has submitted its recommendation of approval thereon; and WHEREAS, the Miami Beach Redevelopment Agency has considered and reviewed the proposed amendments on , 199_, and has submitted its recommendation of thereon to the City Commission; and WHEREAS,the required public hearing with respect to the proposed amendments has been held on this day; and WHEREAS, the amendments set forth below are necessary to accomplish the above objectives. NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: Section 1. On-streeet parking should be minimized. 10. IMPLEMENTATION PROGRAM Alternative Funding Sources and Methods * * * Parking The Revitalization Strategy envisions the need for adequate parking spaces to service the anticipated and existing development ( i.e., existing marina, north and south upland development areas)at or near the entry to the proposed major arterial loop on Alton Road south of Miami Beach Boulevard(Fifth Street). The necessary parking facilities, both public and private, may be integrated with the proposed public development or be provided, in part, on a separate site with sufficient proximity to the private development. If parking is publicly provided and operated, this will be taken into account in lease negotiations. It is likely that some parking will be provided directly on site by the private sector, with the remainder provided by the public sector. * * * Capital Improvement Program 6. A 1,500 car parking Parking facility facilities has have been proposed for the marina upland area. Public parking facilities of from 600 to 900 spaces may be constructed on the publicly-owned marina core parcel and/or the north upland development area. The cost range is $4 12 to 15 thousand per space, with various implementation possibilities and financing options. The balance of the required parking will be provided by the developer of the marina upland area.Thc City may arrange : -- -- -. ;- • : : . -- --;, ' ; . i :•• ; - - : - . ;. ; ; - ;,- -•-_ -- , '; • Beyond the six-year projection of possible capital improvements, specific parking needs might be identified.( e.g., Fifth Street area or at oceanfront parks) and, to continue to stimulate redevelopment, the City may elect to formulate plans for additional parking facilities. * * * Section 2. All ordinances, resolutions or parts in conflict herewith be and the same are hereby repealed. 4 Agenda Item R5F 2a Section 3. If any section, sentence, clause or phrase of this Ordinance is held to be invalid or unconstitutional by any court of competent jurisdiction,then said holding shall in no way affect the validity of the remaining portions of this Ordinance. Section 4. This Ordinance shall become effective on the later date of the 1)effective date of those amendments to the text and future land use map of the City of Miami Beach, Florida Year 2000 Comprehensive Plan which are being processed concurrently with this Ordinance, or 2) if the above referenced amendments to the text and future land use map of the City of Miami Beach, Florida Year 2000 Comprehensive Plan are appealed,the day after all appeals have been withdrawn or resolved, as provided by law.
