Ordinance 98-3139 ORDINANCE NO, 98-3139 AN ORDINANCE AMENDING ORDINANCE NO. 789, THE CLASSIFIED EMPLOYEES SALARY ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA, PROVIDING FOR A 3%SALARY INCREASE EFFECTIVE SEPTEMBER 29,1997; AND A 3% INCREASE EFFECTIVE SEPTEMBER 28, 1998; AND A 3% INCREASE EFFECTIVE SEPTEMBER 27, 1999; ABOLISHING THE CLASSIFICATION OF I.D. OFFICER; ELIMINATING THE TWO TIER COMPENSATION PLAN FOR THOSE CLASSIFICATIONS REPRESENTED BY THE FRATERNAL ORDER OF POLICE (FOP)IN ACCORDANCE WITH THE NEGOTIATED AGREEMENT; REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. ADMINISTRATION RECOMMENDATION Adopt the Ordinance. BACKGROUND The first reading of the Ordinance took place on September 9, 1998. On June 22, 1998, negotiators for the City and the FOP successfully concluded negotiations fora three year collective bargaining agreement. The Contract was ratified by the bargaining unit and then presented to the City Commission for ratification at the July 15, 1998 Commission Meeting. The term of the Agreement will extend for three years from October 1. 1997 through September 30, 2000. Effective with the payroll dates of September 29, 1997, September 28, 1998, and September 27, 1999, of each of those three years, bargaining unit employees will receive a three percent(3%)pay raise. Based on current, active employees the estimated cost for the wage increases are $450,000 for Fiscal Year 1997/1998; $475,000 for Fiscal Year 1998/1999; and, $480,000 for Fiscal Year 1999/2000. continued... AGENDA ITEM b DATE l 0 1-98 • COMMISSION MEMORANDUM PAGE 2 The Tier B language that modified the pay plan by affecting a 15% salary reduction for those bargaining unit employees who were hired after April 1, 1993 has been eliminated. The estimated costs involved to increase the salaries of the affected bargaining unit employees to the Tier A level through three extra step increases of 5% each are $165,000 for Fiscal Year 1997/1998; $168,000 for Fiscal Year 1998/1999; and $172,000 for Fiscal Year 1999/2000. Additionally, as of September 30, 2000,the Tier B Pension Plan for Police Officers will be eliminated at an estimated annual cost of$230.000. Effective on the date that the FOP Agreement is ratified by the City, the two-tier pay plan will be eliminated as follows: Current employees hired under Tier B, Step A shall have their pay advanced by one step on September 29, 1997, one step on September 28, 1998, and one step on September 27, 1999. Current employees hired under Tier B, Step B, will have their pay advanced by one step on September 29, 1997 and one step on September 28, 1998. Current employees hired at Tier B, Step C will have their pay advanced by one step on September 29, 1997. Additionally, the classification of I.D. Officer is being abolished since it is not a classification represented by this bargaining unit. CONCLUSION The Administration recommends that the City Commission approve the attached Ordinance amending Ordinance 789 to eliminate the two tier compensation plan; abolish the classification of I.D. Officer; and, implement the wage provisions of the three-year Agreement negotiated between the City of Miami Beach and the FOP, which the City Commission ratified at the July 15, 1998 Commissi eeting (Resloution No. 98-22840).
