Resolution 3637 + L!'4 RESOLUTION NO. . 363Z f.k WHEREAS, this body has been petitioned by LaGorce Island,Inc. , : owner of LaGorce Island., as per Plat recorded in Plat Book 34, Page 1 83 of the Public Records of Dade County, Florida, to release and relinquish any and all rights or interests the City may have in the easterly five (5) foot strip of land of the area designated "Private Walk" , lying between Blocks 2 and 3 and running from La- Gorce Circle to the waters of Biscayne Bay, as shown on said Plat 1„ of LaGorce Island, and WHEREAS, the said LaGorce Island,Inc. , owner of LaGorce Island now offer to Jive to the City of Miami Beach in exchange for said releases or relinquishments, a new easement five foot wide, described as the strip of land of five foot width, two and a half feet on each side of the center line of the area designated "Private Walk" , between Blocks 2 and 3 and running from LaGorce Circle to the waters of Biscayne Bay, as per said Plat of LaGorce Island. Said easement to be used for the purpose of maintaining storm sewers and for no other purpose. The title of said strip of land designated as "Private Walk" being duly vested in the owner. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Miami Beach, Florida, that the Mayor and City Clerk be, and they are hereby authorized to execute a quit claim deed to said LaGorce Island,Inc. , on behalf of the City of Miami Beach, as to the easterly five fe=t of said area designated "Private Walk" , in accordance with said petition as noted above, and upon receipt of the new five foot easement along the centerline of said "Private Walk" , as above described.
