RESOLUTION' NO. 3640
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH , FLORIDA,
VACATING A PORTION OF AN ALLEY KNOWN
AS "OCEAN COURT" LYING IMMEDIATELY
WEST OF LOT 6, BLOCK 14, IN OCEAN BEACH
ADDITION NO. 2, ACCORDING TO THE PLAT
THEREOF RECORDED IN PLAT BOOK 2 AT PAGE
56, PUBLIC RECORDS OF DADE COUNTY,
FLORIDA, AND GRANTING SUCH VACATED POR-
TION THEREOF TO THE OWNER OF RECORD,
HIS HEIRS OR ASSIGNS.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
Section 1: That that portion of the alley known as "Ocean
Court" , extending north and south through Block
14 of Ocean Beach Addition No. 2, at present
encroached upon by a wall along the westerly line of Lot
6 of said Block 14 and as shown on the attached survey sketch
prepared by Richard F. Giersch, Jr. , Registered Engineer, a
copy of which is made a part hereof and attached hereto , be
and the same is hereby vacated and the use of said vacated
portion of said alley known as "Ocean Court" be and the same
is hereby granted to the owner of record of the above de-
scribed property on the date of the passage of this Resolu-
tion, his heirs and assigns, subject to the proviso herein«
after contained.
PROVIDED, HOWEVER, that if the wall now on said pre-
anises and covering the above described land is ever moved, de-
molished, destroyed by fire or rebuilt, then the above vaca-
tion of said portion of said alley and the grant of the use
of the same shall be immediately revoked, terminated and
absolutely voided without any action on the part of the City
Council of the City of Miami Beach, Florida, and said lands
above described shall again become a portion of said alley
for the public use.
