RESOLUTION NO. 73-14084
WHEREAS , City Council of the City of Miami Beach,
Florida, on February 7, 1973, authorized the execution and
delivery of a contract with ELMER MARMORSTEIN, for architectural
services in the construction of restroom facilities at designated
sites within the City of Miami Beach, at a maximum fee of Six
Thousand Six Hundred and Forty Dollars ($6, 640) , all as set forth
in Resolution No. 73-13904, and
WHEREAS , subsequent to the adoptionof said resolution,
City Manager has recommended that the scope of the project therein
delineated and authorized be expanded to include new maintenance
facilities and restrooms at Normandy Golf Course and a new locker
room facility for handball courts at Flamingo Park, and
WHEREAS , said recommendation will result in an estimated
increase in cost of the construction from $83, 000 to $205, 000, and
WHEREAS, ELMER MARMORSTEIN has agreed to reduce his
percentage fee from 8% of construction costs to 7 .3% of construction
costs with a maximum fee not to exceed $14, 965, and
WHEREAS, an appropriate modification, entitled "Modifica-
tion #1 to Standard Form of Agreement between Owner and Architect"
has been prepared, in a form approved by the City Attorney, and
WHEREAS, the City Manager has. recommended to the City
Council of the City of Miami Beach, that said modification agree-
ment be entered into, and
WHEREAS, the City Council finds that it is in the best
interests of the City of Miami Beach and its residents that said
modification agreement be entered into,
NOW, THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the Acting
City Clerk be and they are hereby authorized to execute and deliver
said agreement in the name and on behalf of the City of Miami Beach,
and the proper financial officers of the City of Miami Beach are
hereby authorized and directed to make financial payments in
accordance therewith.
